Terms and Conditions of Sale
PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY AS YOU WILL BE BOUND BY THEM IF YOU BID AT AUCTION. The auction catalog, if any, and the terms hereinafter set forth, as amended by any posted notices or oral announcements during the sale, is AC Art Subscribe LTD and the Consignor's entire agreement with the purchaser relative to the property listed in our auction or otherwise offered for sale.
By bidding at our auction, whether in person, by phone, absentee bid, or on the internet, you agree to be bound by the following terms and conditions. As used in the following terms and conditions,"We, " "Us," refers to AC Art Subscribe LTD.
The following terms and conditions are here to help you have a successful auction experience.
We will be happy to answer any questions you may have about the material offered here. Information, condition reports etc. should be received 24 hours before the auction day and start time. Thereafter, we will try to accommodate without guarantee.
Bidders must be 18 years or older.
Although we are careful in our descriptions, if you have any concerns about a particular item please DO NOT bid. There are NO returns for personal preference.
1. The property is sold in "AS IS" condition and without recourse, and neither we nor the consignor makes any representations or warranties, express or implied. Catalog descriptions, including on-line catalogs are guides only and are based on sources believed to be reliable but their accuracy cannot be guaranteed of the attribution, authenticity, provenance, origin, size, age or condition of any of the property offered for sale. No warranty, whether expressed or implied, is made with respect to any description or condition report contained in this auction or correspondence. It is the responsibility of the purchaser, prior to the auction, to examine the property and make a determination as to the value, condition, description, provenance, origin, size and age of the property.
Participation in the auction indicates your agreement with the above conditions.
All items are provided on consignment and available for online inspection before the sale. It is the sole responsibility of the buyer to inspect, thru the online images & descriptions, and satisfy themselves regarding condition etc.
Any and all specific questions should be asked prior to bidding. Additional photographs may be supplied upon request. The absence of a condition report does not in any way imply condition. Any condition report provided is only an opinion of AC Art Subscribe LTD.
2. Guarantee Terms: All items in the catalog are sold as described. No statement regarding condition, kind, value or quality of a lot shall be construed to be an expressed or implied warranty, representation or assumption of liability by AC Art Subscribe LTD. If an item is materially different than was described, Buyer shall have 48 hours from the date the property is received to notify the Seller. After the 48 hour period all items are considered 'as is', without recourse and no returns, exchanges, or refunds will be accepted. - No exceptions.
The foregoing guarantee is only valid to the original buyer. The item(s) must be returned in the same condition and packaging as when purchased. Discrepancies of description shall be decided by mutually agreed upon experts whose determination must be in writing and is at the expense of the Buyer.
3. Buyer's Premium: A buyer's premium shall be added to each purchase to reach the total sales price. The buyer's premium is posted on each item detail page.
4. Winning Bid: The highest bidder shall be the buyer and if any dispute arises between two or more bidders, the auction coordinator shall decide the buyer. We reserve the right to reject any bid.
5. Reserve Price: Some lots are offered subject to a reserve. A reserve is a confidential minimum price below which such a lot will not be sold. AC Art Subscribe LTD will act to protect the reserve by bidding through the auctioneer. The auctioneer may open the bidding on any lot below the reserve by placing a bid on behalf of the Seller and may continue to bid on behalf of the Seller up to the amount of the reserve. This may be done by placing consecutive bids or by placing bids in response to other bidders.
6. We reserve the right in its sole discretion at any time before bidding commences to withdraw combine or divide any lot.
7. Inquiries: Please email or call us for specific questions regarding lots at Auction. Answers will be provided in a timely fashion until Auction start time. We may be able to provide more detailed photos, reference and provenance information on most lots.
8. The purchase price paid by the buyer shall be the amount of the final bid plus buyer's premium as indicated in the lot item description. Credit cards will be accepted. Accepted methods of payment are Wire transfers, Master Card, Visa, and Paypal.
Item(s) will not be released until all fees are paid. All purchases are subject to state and local taxes where applicable.
All property must be paid for and removed from our premises by the purchaser at his or her expense no later than 10 business days following the sale. If items are not paid for and removed, we may send the purchased property to a public warehouse for the account of, and at the risk and expense of the purchaser. Storage charges will incur at the expense of the purchaser. Once storage charges have exceeded the cost of the purchased items, the items will be considered abandoned and will be sold off or discarded.
9. Property purchased from us by a successful bidder may not be removed from the auction sale premises until the full purchase price plus the buyer's premium and all applicable taxes have been paid.
10. If the purchaser fails to fulfill these conditions, in addition to all legal remedies available to AC Art Subscribe LTD, we may: a) cancel the sale and retain any payments made as liquidated damages; b) resell the property for the account of the buyer, in which case the buyer shall be liable to us for all its costs and damages, including the commissions for both auctions.
11. The Auctioneer, its affiliates, or their employees consign items to be sold in the Auction, and may bid on those lots or any other lots. The Auctioneer may bid on the behalf of the reserve for the consignor. Auctioneer or affiliates expressly reserve the right to modify any such bids at any time prior to the hammer based upon data made known to the Auctioneer or its affiliates.
SHIPPING TERMS
AC Art Subscribe LTD is not responsible for shipping. The shipping arrangements and the cost of shipping of any purchased item is the sole responsibility of the buyer. We are not responsible for the acts or omissions of carriers or packers of purchased lots, whether or not recommended by us. In no event will we be liable for damage to glass or frames, regardless of the cause.
AC Art Subscribe LTD is in no way liable for any damages that are caused during shipment. All shipping claims must be filed by the buyer directly with the shipper. Shipping damages should be addressed immediately with the shipper.
BIDDING AT AN AUCTION CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS.
Payment
Accepted forms of payment: Visa, MasterCard, Wire Transfer, and Paypal.
Payment is due upon receipt of invoice. Upon the close of auction, you will receive an Invaluable invoice with all pricing details. All invoices left unpaid for four days or more will be automatically be charged to the bidders credit card on file.
Shipping
Accepted forms of payment: Visa, MasterCard, Wire Transfer, and Paypal.
Shipping: All shipping costs fall on the responsibility of the buyer.
PLEASE NOTE:
All items must be paid for before they can be released.
AC Art Subscribe LTD does not have an in house shipping department. Shipping is the sole responsibility of the buyer, for all items.
For shipments to domestic and international locations, while we do not ship directly, we can recommend some shippers who are local to us, and can pick-up your items from our office with your authorization. Clients are free to choose their own shippers, and these recommendations are provided only for your convenience. We will not accept liability for any recommendations of shippers.
The purchaser is responsible for insuring his or her items in transit. Once items have been picked-up or released to a shipper, they are no longer covered under our insurance.
Payment for shipment and arrangements for shipment, must be made with the shipper directly.
Once you have made arrangement with a shipper, please email or fax us authorizing us to release your property to that person or company.
