Terms and Conditions
General
For The purpose of this sale, the Auctioneers shall be deemed to be the agents for both the vendor and the purchaser and shall not be considered or held responsible for any fault on the part of either the vendor or purchaser.
All bidders are required to register before any bid can be considered.
Purchasers
Bidding. The highest bidder will be the purchaser. No persons shall retract a bid and the advance on each lot shall be determined by the auctioneer. The auction creates a contract between the successful purchaser and the auctioneer/vendors the conclusion of which is the payment of the purchasers account. Failure to pay such an account is a criminal
offence and may result in prosecution or court action for recovery
Bidding dispute. Should any dispute arise between two or more bidders, the lot may at the discretion of the auctioneer, be re-offered for sale or a purchaser declared the auctioneers decision being final.
Commission bids. The auctioneers may accept commission bids in advance of the sale equal to or above the lower estimate. In the case of two or more successful equal bids being received the auctioneers reserve the right to declare the first received the purchaser.
Description. While every care is taken to ensure accuracy concerning authorship, origin, age, condition, etc. all statements represent opinion and are not to be
taken as facts. In all cases, the purchaser must satisfy himself in these respects prior to bidding, as the auctioneers will not be held responsible for any descriptions and make no warranty whatsoever. Any lot purchased by a buyer in the room, whether for himself or
as an agent for another is sold subject to any faults or errors of description and no claim shall be made against the auctioneers.
Buyer's premium. All Lots are subject to a Buyer's Premium on the hammer price. The minimum buyer's premium is £4 per lot sold under
£20 or 18% inc VAT over £20.
Online purchasers charge. Lots purchased online are subject to an additional charge for this service to the sum of 3% of the hammer price plus VAT
Payment. In completing the bidder registration and providing your credit card details and unless alternative arrangements are agreed with the auctioneer you authorize us to take payment for successful bids on the hammer price plus all costs and fees including, but not necessarily, restricted to buyers premium, credit card charge, and online purchasers charge.
All goods must be cleared immediately after the sale has finished or arrangements made with the auctioneers for later collection. Full payment for all purchases must be made before any items leave the saleroom. Interest charges may be made after a period of 3 days on any outstanding amount.
Third party liability. Neither the auctioneers nor the vendors shall be responsible for any loss or damage or injury occasioned to or sustained by any person on the premises before, during or after the sale,
no matter how the same may arise.
Storage. Goods not removed immediately may be moved by the auctioneers to a storage area. The auctioneers accept no responsibility for any damage which may occur as a result. The auctioneers also reserve the right to make transport and storage charges
at their discretion. A charge of £15 + VAT per day
and reasonable transport costs may be charged
Electrical goods. All electrical goods are sold as antiques only and must be tested by qualified electrician prior to use.
Auctioneers' Margin Scheme. Lots which are marked with a dagger (†) in the catalogue will be required to pay VAT on both the hammer price and the Buyer's Premium.
It shall be deemed that all purchasers have read and understood these conditions and agree to be bound by them prior to bidding for any lot.
Vendors
Vendor's Commission. A commission of 15% + VAT will be charged on the hammer price of all lots.
Loss and Damage. We cover goods stored on our premises against the risk of fire, burglary and water damage. We charge 1% per £100 value of your item on the maximum estimate with a minimum charge of £1. We must be informed in writing if you wish to waive this cover.
Electrical goods. All electrical items must meet current Trading Standards legislation. The vendor must have all goods tested by a qualified electrician.
Soft furnishings. The sale of soft furnishings is strictly regulated by law. Goods found to be in breach of fire regulations must be removed at the vendor's expense. The auctioneer reserves the right to disposed of these items at the vendor's expense.
Withdrawing from Sale. Any item withdrawn from the sale may incur a commission charge based on the high estimate, and a charge equivalent to the Buyer's premium.
Unsold Lots. Unsold lots which the vendor does not wish to offer for resale should be collected within 3 days, a storage charge of £15 + VAT plus reasonable removal costs may be charged after this period.
Reserve. The vendor may set a reserve for the minimum sale price for any lot. The auctioneers reserve the right to refuse for sale any lot which they consider to have an unreasonably high reserve. With the vendor's permission the auctioneer's discretion may be used to sell an item at up to 10% below the reserve. If an item has been unsold after three sales and not collected within three days we reserve the right to sell it at it's best possible price.
Royalty Payments. The sale of a work of art by a living artist above €1,000 will incur a royalty payment to the Design and Artists Copyright Society. It is agreed for the auctioneer to make this payment where applicable on the vendor's behalf.
Valuation charges. Valuations not for the purpose of sale may be undertaken for a charge of £100 + VAT per hour, £350 + VAT per half day or £600 + VAT per day. In the case of items going to sale this may be waived at the auctioneer's discretion.
Lotting Fee. All lots are subject to a £3 inc VAT fee per lot. This applies to all lots not specifically items with in a lot at the Auctioneer's discretion.

Accepted Forms of Payment - cash, debit card, cheque( subject to clearence) credit card - 3% surcharge + collection in person only.

Buyers' Premium

18% incl VAT; min buyers premium is £4 per lot
