Participation in the auction implies unconditional acceptance of the following terms and conditions

Contract

Prior registration upon presentation of official piece of identification for any potential buyer is required. The sale is made in cash and in euros. The prices listed in the catalogue are estimates. The highest and last bidder will be the successful purchaser. It will be pay, in addition to the auction selling, 20% of the hammer price for the lots sold for under € 100,000. From € 100,000, the fee will be 15%, from € 150,000, the fee will be 13%, and from € 200,000, the fee will be 10%. For the works on which the resale right is applicable, the buyer must pay in addition to the hammer price and buyer's fees, the amount corresponding to these rights under Belgian law. For lots won online during the live sale, a commission of 3% on the hammer price will also be paid by the buyer. Shipment costs and insurance for sending lots will also be charged where applicable. The buyer is liable for the payment of VAT (21 %) if it is applicable on fees, sales commissions live and transportation costs. In case of error or dispute, the lot will be re-auctioned. The bailiff or the notary sovereignly decides any difficulty that may arise during the sale, without appeal. In any case, the organizer cannot be held responsible for any problem due to technical or computing difficulties. All benefits and risks are transferred to the buyer on completion of the auction. The buyer is deemed to be acting in his own name and is individually liable for the full payment of the amounts due. He will have to pay upon receipt of invoice before removal of lots that will have been awarded. The organizer reserves the right to cancel the sale if the total amount is not paid within thirty days after the auction invoice. The indications appearing in the catalogues, advertisements, brochures or other written authorization from the organizer must be considered as mere indications that entail in any case the responsibility of the organizer. The organizer makes no warranty as to the accuracy of a statement of the author, the origin, date, age, attribution, provenance, weight and size or the physical condition of the lot. No employee is authorized to give any guaranty in this respect. The organization of a public exposure before the auction allows the buyer to examine the lots presented so that no claim will be accepted after the auction. The colors of the reproduced lots in the catalogue may be different due to printing method. The organizer reserves the right not to accept the entrance or to request departure to anyone who disturbs the auction. The organizer, at its sole discretion, also reserves the right to change the numerical order in catalogue, to set the progress of bids, to refuse any bid, to separate, to join or withdraw any lot from the sale, or to suspend the auction. Only the French text of these conditions shall prevail. In event of litigation, the courts of Brussels shall have sole jurisdiction.

Payment

Sales are executed in cash in euros. Catalogue prices are starting prices.

The purchaser of an item will be its highest and last bidder.

If the sale is contested or an error is made, the lot will be re-auctioned.

The bailiff or executing notary will decide any issues that may arise during the sale without appeal.

Premium

The purchaser of an item will be its highest and last bidder. In addition to hammer price, a buyer's fee will be charged : 20 % plus VAT if applicable; for works to which Artist's Resale Rights are applicable, the successful bidder will pay a 4 % supplement to total sale price and legal costs. If the sale is contested or an error is made, the lot will be re-auctioned. The bailiff or executing notary will decide any issues that may arise during the sale without appeal.
Live Auction : an additional buyer's premium of 3% ex. taxes (3,59 inc. taxes) will be charged to this buyer's premium

Taxes

The buyer is liable for the payment of VAT (21%) if it is applicable on fees, sales commissions live and transportation costs

Condition

The indications appearing on the catalogues, advertisements, brochures and any other written material produced by The Auction House should be considered as simple indications and are not binding in any case.

The Auction House do not guarantee the exactitude of a declaration relative to the author, origin, date, age, attribution, provenance, weight or material state of the lot. No employee is authorised to give such guaranties. Colours of the reproduced lots in the catalogue may diverge due to the impression technique.
Prior viewing will provide the buyers an opportunity to confirm the nature of the lots and their current state, no complaints will be accepted after the sale.
Only the original French version of these conditions will be deemed valid.
