TERMS AND CONDITIONS
OF SALE
All bidders at Artimore Auctions acknowledge that they have read these terms and conditions of sale and agree to be bound thereby. If you do not understand any of these terms or conditions, please ask a staff member for clarification before registering.
Artimore Auctions is an auction house who acts as agent of the seller who contracts with the Purchaser.
Artimore Auctions warrants the authenticity and conformity of catalogue description with actual conditions.
Artimore Auctions has sole discretion to withdraw any lot from the sale without any consequences.
Artimore Auctions reserves the right to prevent any person from participation in auction.
Artimore Auctions disclaims all responsibility for any latent physical and legal faults.
All claims, which may arise, will be settled according to the French law regulations.
LIMITED WARRANTY
--We warrant the authenticity and condition of each lot catalogued on the terms and conditions set forth below.
--All property is sold « as is », and neither the auctioneer nor any consignor makes any warranties or representation of any kind or nature with respect to the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty, or description, genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the property and no statement made at the sale, or in the bill of sale, or invoice or elsewhere shall be deemed such a warranty of representation or an assumption of liability.
--The buyer must take possession of the objects in the condition in which they are at the time of being bid.
--The benefits of these warranties are not assignable and are applicable only to the original buyer of the lot, and are conditioned on the buyer returning the work in the same condition as at time of sale and in the time period specified.
--The buyer's sole remedy under these warranties shall be the rescission of the sale and refund of the original purchase price paid for the item, and this remedy shall be exclusive and in lieu of any other remedy which might otherwise be available to the buyer as a matter of law.
--In the event that a buyer claims that an item is not authentic, Artimore Auctions shall have no obligation to rescind the sale unless the buyer has obtained, at the buyer's expense, the opinion of two recognized experts in the field, who are mutually agreeable to Artimore Auctions and the buyer, that a lot or portion thereof is not authentic.
ADVICE TO PROSPECTIVE BIDDERS
--The highest bidder is the Buyer.
--Total amount for purchased items should be paid within 7 days since the date of the auction.
--If the contract shall be broken by the Buyer the deposit and account will be forfeited to Artimore Auctions advantage. In such case the Artimore Auctions reserves the right to accomplish the contract at court and to charge all expenses to the buyer.
--We are not responsible for any failure of online bidding resulting from Internet connection failure or software malfunction.
--Your bid constitutes acceptance of Artimore Auctions conditions and terms of sale.
--Your bid is legally binding and enforceable contract.
--If you are a high bidder your are obliged to complete the transaction according to terms of Artimore Auctions conditions of sale.
--Inspection of property
Prospective bidders should investigate a lot thoroughly before bidding. By bidding the Bidder acknowledges that Bidder has investigated the lot to his or her satisfaction, or, that Bidder has chosen not to do so, and agrees to accept the lot being bid on with no objections after the sale closes. If you are uncertain please contact us with your questions prior to bidding. If you are still uncertain after we reply, please refrain from bidding. Photos and other graphic material contained in any listing of generic or duplicate lots may be stock presentations and not necessarily of the specific lot.
--Reserves
All lots are subject to a reserve, which is the confidential minimum price agreed to with the seller below which the lot will not be sold. The reserve will never be higher than the low pre-sale estimate, and will never be lower than half the low estimate. Artimore Auctions may implement such reserve by opening the bidding on behalf of the seller and may bid up to the amount of the reserve by placing successive or consecutive bids for a lot in response to other bidders.
--Estimates
The estimates provided are intended as a guide to bidding. The figures are educated guesses, based on recent values. A bid between the listed figures would, in our opinion, have a chance of success (at the time the catalogue was prepared). The estimates are exclusive of the buyer's premium, and may be revised at any time prior to the auction.
--Removal of property
All lots purchased shall be removed at the purchaser's expense by the end of the fifth business day following the sale. Purchases not so removed will be treated as set forth.
--Shipment
Upon request, Artimore Auctions will take care of the shipping of purchases to out-of-town buyers at an additional charge for packing, postage and insurance. Unless specific instructions are received, Artimore Auctions is the sole judge of the method to be used for shipment. Packing and shipping costs will be noted on the invoice mailed to successful bidders after the sale, and are based on the actual costs involved.
--Lots not returnable
Lots are sold as is and are not returnable. Books, manuscripts, prints, drawings, photographs, signatures, or any other property offered in a lot comprising more than 3 items, whether or not such items are individually named, constitute «Grouped Lots.» Such «Grouped Lots» are not subject to return for any reason.
--Import tax
If the lot is sold abroad, the Buyer has to pay all the import taxes needed.
--Payment Information
According to our terms you are obliged to pay for your lots within 7 days. You can pay us by bank transfer, credit card, PayPal (3% of the price are added) , check or cash.
We accept payments in Euro and US dollars. We consider payment done , when our account is credited - the copies of wire transfer, electronical confirmations may not be accepted.
--Buyer's Premium
Buyer's Premium is 15% of the hammer price.
