Terms of sale:
The Auction House Cornette de Saint Cyr is a voluntary sales of company governed by the law of 20 July 2011. The house acts as sales agent of the seller who contracts with the purchaser.
The auctions organized by the Auction House Cornette de Saint Cyr are subject to these conditions:
The estate for sale
The prospective buyers are invited to examine the goods may be interested in the exhibitions organized prior to the auction by the Auction House Cornette de Saint Cyr. Status reports are provided for information purposes and graceful on request, by mail, phone or email. These are based on artistic and scientific knowledge on the date of the sale and any errors or omissions can not entail responsibility for the Auction House. The entries listed in the catalog are established by the Auction House and the expert who assists if necessary, subject of notifications and adjustments announced at the time of the presentation of the lot and entered in the minutes of the sale. The dimensions, weights and estimates are given as a guide. The colors of the works entered in the catalog may be different due to printing process.
The lack of mention of state to catalog does not imply that the lot is in perfect condition or free of restoration, wear, cracks, relining or other imperfections. The goods are sold in the state they were at the time of the sale.
No claims will be accepted once the pronounced auction, prior exposure that allowed the examination of the object. In case of withdrawal of an object prior to the sale by an applicant and after the publication of the catalog or, in case of modification of the reserve price making impossible the sale today of the object, the seller will be required to pay the Auction House Cornette de Saint Cyr as compensation the buyer and seller fees calculated based on the median estimate indicated in the catalog. Delivery of the object removed from the sale will be suspended settlement of such fees. In the absence of regulation, the subject will again be offered for sale under the terms of the original sale of requisition.
Auction
The auctions follow the order of the catalog numbers. Bidders are invited to make themselves known to the Auction House Cornette de Saint Cyr before the sale to allow the registration of their personal data.
The usual way to bid is to be present in the room. However, any bidder who wishes to make a bid in writing or a telephone bid should use the form provided for this purpose at the end of the catalog or on the www.cornette.auction.fr site. This form must reach the Auction House Cornette de Saint Cyr along with a bank account number or bank details at least two days before the sale.
The Auction House Cornette de Saint Cyr gracefully load of the telephone as well as purchase orders. In all cases, the Auction House Cornette de Saint Cyr can not be held liable for telephone communication problem and an error or omission in the execution of orders. In the event of two identical purchase orders, this is the most ancient order which will take preference. If bidding in the room to an amount equivalent to a purchase order, this bidder will have priority.
The highest and last bidder will be the successful bidder. In case of double auction actual recognized by the auctioneer, the lot will be relisted, all present may participate in the second auction.
Payment
The sale is made in cash and conduct in euros. Payment must be made immediately after the sale. In the event that the purchaser has not made known their personal information before the sale, he must prove his identity and bank references.
Purchasers pay in addition to the auction, by lot separately the following charges and taxes:
- From 1 to € 20,000 24% VAT (except for VAT 28.80% 25.32% books TTC)
- From 20,001 to 600,000 €: 20% tax (VAT 24% except for books 21,10% TTC)
- Beyond € 600,001 12% VAT (except for VAT 14.40% 12.66% books TTC)

For consignments from a third country to the European Union, should be added to the import VAT is:

For lots whose numbers are preceded by the sign: ** an additional 20% VAT of the hammer price.
he contractor will make the payment in the following ways:
- In cash within the limits of the law.
- By bank transfer.
- Check with mandatory submission of an identification document. Cheques drawn on foreign banks are only allowed after prior approval from the Auction House Cornette de Saint Cyr. Buyers are advised to provide a letter of credit from their bank for a value close their purchase intent.
- By credit card: except American Express.
Default
If payment of the amount of the tender and fresh, a notice will be sent to the purchaser by registered letter with acknowledgment of receipt. If payment of the amount due to the expiration of the period of one month after that formal notice, the fees of the purchaser and to support recovery charge an additional fee of 10% of the price of auction, with a minimum of 250 euros.
The application of this clause does not preclude the allocation of damages and the costs of the proceedings would be required, and without prejudice to the possible implementation of mad bidding procedure governed by Article L 321- 14 of the Commercial Code.
As part of the bidder procedures, the Auction House reserves the right to claim from the defaulting purchaser the payment of the difference between the original contract price and the auction price of irresponsible bid, whichever is lower and the costs generated by the new auction.
The Auction House Cornette de Saint Cyr reserves the right to proceed to offset any amounts owed to the defaulting buyer. Similarly, the Auction House Cornette de Saint Cyr reserves exclude from any future auction, any bidder who does not respect the present conditions of sale.
The Auction House Cornette de Saint Cyr is adherent to the Central Register of unpaid prevention Auctioneers from which the payment incidents are likely to registration.
The rights of access, rectification and opposition for legitimate reasons are to be exercised by the debtor concerned to the SYMEV 75016 Paris 15 rue Freycinet.
Collection of purchases
No prize will be delivered to purchasers before payment of all sums due. In case of payment by uncertified check or by wire transfer, lots may be deferred until redemption.
Once the auction, the objects are placed under the responsibility of the purchaser. For the removal of the lots that have not been withdrawn on the day of the sale, it is advisable to first contact the Auction House Cornette de Saint Cyr 01 47 27 November 24. The small paintings and art objects can be withdrawn by appointment at 6 avenue Hoche - 75008 Paris, Monday to Friday from 9:00 to 1:00 p.m. and 2:00 p.m. to 6:00 p.m. (17 pm Friday). After a period of fifteen days of storage charge, it will be charged 36 euros per month and per lot or 9 euros per week per lot. Every week started is deemed due. Furniture, and generally bulky parts, are kept in the warehouses of our suppliers. Storage costs are the responsibility of the buyer and will be billed directly by the service providers at the rates in force. Shopping objects do not assume responsibility for the Auction House.
The transport of lots is made at the expense and under the responsibility of the contractor.
Export
The export of artworks considered cultural property is subject to authorization from the Ministry of Culture (Article L 111-2 of the Heritage Code). The export to a country of the European Union is subject to obtaining an export certificate of cultural property issued by the competent department of the Ministry of Culture within a maximum period of four months from the date of request.
This certificate can be requested by the Auction House for the account of the buyer after the sale. The export to a third country of the European Union is also subject to obtaining an export certificate, the issuing of an export license and a customs declaration.
In this case, the buyer must secure the services of a freight forwarder to solicit the required permissions. The Ministry shall issue or refuse the certificate within a maximum period of four months from the request. The export license is issued within two weeks of obtaining the export license.
The required documents must be presented to the requisitioning of customs officers. It should be noted that the law punishes anyone penalties exports or attempts to export cultural property without having obtained the required authorization (Article L 114-1 of the Heritage Code).
Works of art are considered cultural property according to criteria of age (generally at least 50 years) and value (price including VAT) which varies according to their categories (150 000 or more for paints, € 15 000 or more for prints ...). These thresholds are set by Decree No 93-124 of 29 January 1993 and Regulation EC No 116/2009 of 18 December 2008. The auction house may not be held liable for any delays or refusal to issue an export license by the Ministry of Culture.
Legislative and jurisdictional competence
These terms and conditions are governed by French law. Any dispute regarding its existence, validity and execution will be decided by the court having jurisdiction in Paris.
Shipping Terms
By placing a bid you are entering a legal and binding contract. Upon placing a bid, you are promising to pay for your purchases in a timely manner according to terms of this agreement. Non-paying bidders will be added to the No Bid list. A non-payment fee will be added to your bill for Legal & Processing fees. A minimum of $500 will be applied. We will turn it over to our collection agency and will prosecute to the full extent of the law. Please do not bid if you do not intend to pay.
