TERMS OF SALE

Prospective Buyers must register with Provenance prior to bidding at auction. Full name or business name, permanent postal address, telephone number, email address and cell number must be provided. Provenance may from time to time request ID numbers or proof of identity.
The Buyer shall pay a premium of 15% (inclusive of VAT) on the hammer price of each and every lot. This charge will be added to the Buyer's invoice. A card payment shall incur an 18% commission on the hammer price.
Purchases made through Invaluable or The-Salesroom incur a 3% additional charge.
Credit cards an additional 3%. Only Visa and MasterCard will be accepted.
All lots are sold as shown with all faults, imperfections and errors of any description. Neither Provenance nor the seller being in any way responsible for the genuineness and authenticity, errors of description of any lot or lots, or any fault or defect however caused. No warranty whatsoever is given by Provenance or any seller to any buyer in respect of any lot and any implied conditions or warranties are hereby excluded. Care is taken to ensure that any statement as to origin, date, age, attribution and condition is reliable and accurate, but all such statements are statements of opinion are not to be taken as representation of fact. The absence of any reference to the condition of a lot does not imply that the lot is free from imperfections.
A bid shall be taken as proof that the Buyer has made himself fully acquainted with the lots for which he bids.
All accounts are payable on the day of the sale. No collections will be entertained during the course of the auction. All purchases must be collected from the Auction Premises within 5 Days from the end of the sale. Any lot not collected within the period advised will be stored at the purchaser's expense at the rate of R100-00 per day per lot plus VAT.
The highest bidder shall be the purchaser. Should any dispute arise the Auctioneer shall have the absolute discretion to put up the disputed lot or to declare the purchaser.
The Auctioneer's decision is final in all cases.
The Auctioneer has the right to advance the bidding at his absolute discretion. Normal increments are at a rate of approximately 10%.
Provenance has the right to refuse any bid, to divide any lot, to combine any two or more lots and to withdraw any lots from the sale without any given reason.
On the fall of the hammer responsibility for items sold will pass to the Buyer. Provenance may not be held responsible for any loss or damage that may occur to items left at their premises. Any risk passes to the Buyer.
Provenance Vendu Roll is final. No dispute will be taken into consideration as to the correctness of it.
Any estimates given or shown by Provenance are a considered opinion and provided only as a guide to prospective Buyers. They have no bearing or relation to reserve prices if any.
1. Commission Bids: - Provenance will execute absentee bids for prospective buyers. This service is free. Bids must be received no later than 12 hours prior to the auction. Bids must be in writing. Provenance will endeavour to purchase as cheaply as possible but cannot be held responsible for any errors or omissions by any member of staff.
2. Telephone Bids: - Provenance is willing to undertake telephone bids for Catalogue Sales. Telephone bids must be placed no later than 24 hours prior to the auction. No guarantee as to availability of line can be given. Lines are booked on a first come first serve basis. Provenance cannot be held responsible for any losses arising from this form of communication. Right of admission is reserved and entry is at your own risk.
