GENERAL CONDITIONS
1. Peacock s.r.l. is responsible to sell the objects entrusted in the name and on behalf of principals. The effects of the sale directly affect the Seller and the Buyer, without the assumption of any other liability from Peacock s.r.l. in addition to those resulting from the mandate.
2. Sales are made to the highest bidder. Third party transfers of lots wich have been already awarded are not accepted. Peacock s.r.l. will deem the contractor solely responsible for paying the contractor. Therefore the participation in the online auction and on behalf of third parties must be previously communicated.

3. The auction buyer will pay a fee for each lot, equal to 22.99% on the award price up to € 100,000 and the 20.57% on the amount of money in excess, including VAT and income taxes.

4. The assessments of the items in the catalogue are purely indicative and in Euros. As concerning the descriptions you will find there , we kindly remind you that they are a merely opinion and they are purely indicative and do not imply any responsibility on the part of Peacock s.r.l.

5. The lots up for auction are sold in the state in which they were at the time of acquisition for the auction, with all their defects and imperfections, and the lack of explicit references about does not imply that they are free.The antique goods by their very nature may have been subject to restoration or may have undergone changes of various kinds, such as the 'sovrapitturazione'(that is objects that have been painted again); interventions of this nature can never be considered latent defects or infringement of a lot.
As for the electrical or mechanical goods, we kindly inform you that they are not checked before sale and they are purchased by the purchaser at his/her own risk.
The watches or clocks' mechanical movements are to be considered not overhauled.

6. On sold lots Peacock s.r.l. will charge a commission of 18.15% VAT included.

7. Even if it is an online auction you can see the lots you are interested in personally at our office and the auctioneer will be available for any clarification. In that case the exposition will aim to examine the state of conservation and the quality of items and to clarify any errors or inaccuracies contained in the catalogue. All items are sold "as seen on the web."

8.Peacock s.r.l. may accept commissions of purchase of the items for sale on a precise mandate for those who can not be present during the sale. Lots will always be bought at the lowest price as to other bids on the same lots. Peacock s.r.l. is not responsible, while doing its best, for any errors that might occur in the execution of bids. While filling in the form, the bidder is requested to carefully check the lot numbers, descriptions and estimated figures. We will not accept purchase warrants with unlimited offers. In the case of two identical written bids for the same lot, the one received first from us will prevail.

9. The payment of the purchased lot or lots , including the rights of the auction house, must be sent by bank transfer to Peacock s.r.l. within 30 days from date of award.

10. Lots that were bought and paid must be picked up within 10 working days after payment, or by the same buyer or by the forwarding agent who has been entrusted by the purchaser. Otherwise the custody rights are to be due to Peacock s.r.l. which will be exonerated from any liability regarding the custody and eventual deterioration of the objects. The weekly cost of storage will amount to 26 euros.

11. The buyers are required to comply with all laws and regulations in force in relation to items subject to notification, with particular reference to Law n. 1089 of June the 1st, 1939. The export of objects is regulated by the above-mentioned Law and customs and tax laws in force. Peacock s.r.l. refuses all responsibility to any buyer as well as any restrictions on export of awarded lots. The contractor shall not, when exercising the right of pre-emption by the state, claim any reimbursement or compensation from Peacock s.r.l. or from the Seller.

12. The Legislative Decree of 22 January 2004 regulates the export of Cultural heritage outside the territory of the Italian Republic, while the export outside the European Community is also subject to the rules provided by the EEC Regulation n°. 391/92 of 9 December 1992, as amended by EEC Regulation no. 2469/96 of 16 December 1996 and by EEC Regulation n. 974/01 of May 14, 2001. Peacock s.r.l. is not responsible for the release of expected export permits and can not even guarantee the release of the permits themselves. The denial of these permits can not justify the cancellation of the purchase or non-payment of the purchased goods.

13. The terms of sales just now specified are automatically accepted by those participating in the auction.
For all matters not provided for in this contract, please refer to the rules of the Italian Civil Code.
Notwithstanding any different criterion, the parties elect the Court in Brescia as jurisdiction to resolve disputes in the interpretation of this contract.

Payment
