Terms & Conditions:
All bidders must be at least 18 years of age to register and participate in the auction whether in-person or online. All bidders that decide to register or participate in the auction agree to be bound by and accept these Terms and Conditions.
All property sold at auction is sold as is where is and neither Ballenger Auctioneers nor any auctioneer, employee, seller, consignor or other representative to make any warranties, representations or guarantees with regard to the property including but not limited to condition, source, age, quality or authenticity of the items. Ballenger Auctioneers is not responsible for the correctness of descriptions in advertising or auction catalogs. All bidders have the responsibility to inspect items in person or online and do their due diligence by researching the items they are interested in purchasing. Bidders must rely on their own inspection of items and agree to release and hold harmless Ballenger Auctioneers, employees, independent contractors, and other representatives.
ALL SALES ARE FINAL.
Ballenger Auctioneers reserves the right to decide if bidders are qualified and/or in good standing with our auction company. Ballenger Auctioneers may disqualify any bidder at any time before, during or after the auction. Ballenger Auctioneers may refuse bids and/or terminate the purchase for any reason.
At our auctions all items are to be considered with reserve unless we use the words "to be sold without reserve" or "No Reserve" on the main description of either the auction item or in the main description of the entire auction. Ballenger Auctioneers reserves the right to withdraw any items before or during the auction sale. If items do not reach the reserve then Ballenger Auctioneers holds the right to either pass on the sale or hold the sale subject to seller approval. If we decide to hold the sale subject to seller approval we will have the seller decide within 24 hours of the auction.
Ballenger Auctioneers will make the final determination as to the winning bidder of each item sold during the auction. If there is a mistake or confusion as to who was the highest bidder then Ballenger Auctioneers reserves the right to determine the winning bidder by either re-opening the bid or simply selecting who the auctioneer saw as the winning bidder.
If for any reason a bidder, buyer or auction participant decides to bring legal proceedings against Ballenger Auctioneers, employees, auctioneers, or other representatives the Buyer agrees to bring suit subject to the jurisdiction of the courts in Gallatin County, Montana. The laws of the State of Montana shall govern the terms and conditions.
The Buyer expressly agrees to indemnify and hold Ballenger Auctioneers, sellers, consignors, employees, independent contractors and other representatives harmless from and against all claims, losses, expenses, damages or liability, (including but not limited to attorney's fees), directly or indirectly caused by or resulting from Buyers negligent acts.
All items purchased by bidders in attendance at the auction must pay for and remove all items from the premises the day of the auction. All items purchased by online bidders at the auction must remove items purchased within 5 business days from the date of the auction. The Buyer agrees to hold harmless Ballenger Auctioneers, employees, independent contractors and other representatives from any and all liability for any damages of the property during removal. A Buyer upon purchasing an item on the day of the auction is responsible for getting insurance if so desired to protect the item against theft, damage, etc. If an item is not picked up or arranged to be picked up within 5 business days then Ballenger Auctioneers reserves the right to start charging $20 per day for each item that is left. After 15 days, Ballenger Auctioneers reserves the right to dispose of the item and the Buyer will still be responsible for storage costs and disposal costs.
All items must be paid for in full before the item is removed. Ballenger Auctioneers accepts Cash, Cashier's Check, Local State of Montana Check, Visa, MasterCard or Discover. We can also accept payment via Pay Pal. Also, Ballenger Auctioneers reserves the right to charge a bidders credit card if we have it on file for any balances due. All monies must be in U.S. dollars and we do not accept out of state checks (Only Montana checks accepted).
Items with titles will be provided to Buyers on the day of the auction if the property is paid in full using Cash. Otherwise, titles will be mailed to the Buyers address they provided when they registered for the auction approximately 10 business days from the date of the auction or until the check clears.
Bidders, buyers and purchasers of items at auction are solely responsible for arranging for items to be picked up and or arranged for items to be shipped. All shipping, packing and handling charges are at the sole responsibility of the Buyer. .
Any persons who desire to become a Bidder on any firearms are required to be 18 years of age for any long gun and 21 years of age for any hand gun. Ballenger Auctioneers is a licensed Federal Firearms Licensed (FFL) dealer. Any Bidders who desire to bid on and purchase any firearms in our auctions cannot have been convicted of a felony, have any restraining orders, or have any reason that they would not pass a NICS FFL Background Check. Ballenger Auctioneers reserves the right to run a NICS FFL Background check on any purchaser. If you are an online bidder out of the area and you are the successful bidder than you are responsible for all shipping and handling charges and arranging the firearm to be shipped to a local Federal Firearms Licensed (FFL) dealer of your choosing closest to where you live. The successful bidder must also have the FFL dealer email us their FFL license and contact information.
Ballenger Auctioneers reserves the right to conduct the auction using any method of their choosing including but not limited to Live-In Person Only, Live-In Person with Internet Bidding or a Timed-only auction, Absentee Bidding or any combination. Ballenger Auctioneers reserves the right to change the method of conducting the auction at any time including but not limited to canceling the internet bidding for any reason.
Bidders understand, acknowledge and accept that Ballenger Auctioneers shall not be responsible for any and all damages resulting in but not limited to the loss of internet connection, technical difficulties, loss of telephone connection, the inability to execute a bid, missed call, missed email or a misunderstanding of any kind with regard to purchasing or bidding.
If we offer internet bidding through the use of third party hosted auction platforms the bidders must first register to bid on their platforms. These hosted platforms require registration first in order to bid. Bidders understand and acknowledge that Ballenger Auctioneers is not responsible for the bidder's approval to bid and that Ballenger Auctioneers has the right to refuse or decline any bidder without limitation. Bidders agree and acknowledge that Ballenger Auctioneers will not be responsible for any errors or failures to execute bids placed via Internet Auction Platforms including but not limited to, errors or failures caused by a loss of internet connection, technical problem, or failure to relay the bids placed for any and all reasons.
Floor bidders who are attending the auction in-person agree to pay a buyers premium of 5%. Internet bidders who are bidding online using third party auction platforms agree to pay a buyers premium of 15%. In addition, buyer is responsible for arranging for items to be picked up or shipped and any and all handling, packing and shipping costs.
Shipping & Pick-up
If you are attending the auction in-person then you must pay in full for your purchases and pickup all items on auction day.
If you are bidding online then we will email you an invoice with a link to pay via PayPal. PayPal allows you to use a credit card and you do not need a PayPal account. You must pay for your online purchases within 3 business days of the auction to avoid late fees.
For items purchased online we have partnered with the UPS Store of Bozeman to help you arrange for the shipping of your purchases. Buyer is responsible for all shipping and handling charges. After your invoice has been paid we will contact the UPS Store of Bozeman to pickup your items. You will need to pay for the shipping and handling once they contact you to ship your items. In the event the UPS Store of Bozeman is unable to pickup your items we will contact a different shipping vendor.
