Buyer Terms and Conditions

I. INTRODUCTION
All bidders are responsible for reading and understanding the following terms of sale, as well as any supplemental notices or announcements.

All property offered and sold through Showplace Antique + Design Center's Online Auctions Department is offered and sold on the terms and conditions in this entire document. By participating in any sale you acknowledge that you are bound by these terms and conditions.

II. CONDITION REPORTS AND AUTHENTICITY
The absence of condition remarks in an item description published in the online auction catalog does not mean that the item is in perfect condition.

It is the buyer's responsibility to know the condition of property before bidding. Many items are available for preview by appointment from 10:00am to 5:00pm Monday through Sunday. Please contact Showplace's Online Auctions Department at least 24 hours in advance.

It is the buyer's responsibility to know all the conditions and corrections before the sale.
All lots are sold "As Is" and Showplace makes no warranties or representations of any kind with respect to any property offered for sale, since the auctioneer is acting solely as an auction broker and, unless otherwise stated, Showplace does not own the property for sale. Therefore the auctioneer makes no warranties in respect to the catalog description or any other statements of attribution, authenticity, provenance, origin, size, age, or condition of any property up for sale.

Buyers must rely on their own knowledge when purchasing merchandise. ALL SALES ARE FINAL, therefore it is crucial that the bidder knows all the information about a lot before bidding on it.

All statements contained in the online auction catalog or in any bill of sale, invoice, or elsewhere as to the authorship, quality, variety, provenance, importance, exhibition and literature of historical relevance or physical condition are qualified statements of opinion and not representative or warranties.

If a buyer doubts the authenticity of an item, he/she has 30 days from the date of the sale to submit, at his own expense, an opinion in writing from a recognized expert, approved by Showplace and the purchaser, regarding authenticity. If the expert judges the item inauthentic, it may be returned in the same condition as at the time of sale and the buyer's full purchase price will be refunded. Refunds do not include the cost of transportation, shipping, insurance, or any other expenses that may be incurred by the buyer. It is the buyer's responsibility to pay in a timely fashion, such that the property can be released and inspected within the 30-day time frame.

The descriptions of clocks, jewelry, and lighting devices, whether in catalogs, condition reports, or any other form may be incomplete and not identify every mechanical replacement, repair, or object. The absence of reference to the condition of a clock, jewelry, or lighting device does not imply it to be in working condition or without defects, repairs, restorations, or replacement parts. No warranty is made that any clock or watch is in working condition or without defects, restorations, or working parts. Buyers are advised to check if a watch or clock is working prior to placing a bid in the auction. We sell clocks, lamps, and all electrical items only for their decorative value. They are not represented to be in working order, but they may be. Bidding in a Showplace auction indicates that you accept these terms.

WE RESERVE THE RIGHT TO WITHDRAW ANY PROPERTY BEFORE THE SALE AND SHALL HAVE NO LIABILITY WHATSOEVER FOR WITHDRAWAL OF PROPERTY.

III. BIDDING
A. Introduction to bidding
By bidding in the auction the buyer and all bidders agree to be bound by these terms or those changed and supplemented, whether Internet bidding or placing an absentee or phone bid.

The highest bidder acknowledged shall be the purchaser. In the event a phone bidder is acknowledged as the highest bidder, he/she will be informed immediately and is responsible for paying the highest bidding price plus buyer's premium, necessary shipping fees, and applicable taxes.

Absentee bidders acknowledged as the highest bidder will be informed within 72 hours after the end of the auction and are bound to payment.

All successful bidders will be notified and invoiced within 72 hours following the sale.
In the event of any dispute between bidders, the auctioneer shall have sole and final discretion either to determine the successful bidder or to re-offer and resell the article in dispute.

All Internet, absentee, and phone bidders are charged a buyer's premium of 20%.

IV. RESERVES AND ESTIMATES
A reserve is the confidential minimum price established by the auction house and the consignor. If the lot does not reach its reserve the lot will be bought in-house.
Showplace has a right to bid until the lot has reached its reserve. Some lots will have no reserve but in most cases the consignor has established one. Estimates are neither a representation nor prediction of the actual selling price that will be realized at the auction, post-auction sale, or upon resale.

V. SALES RESULTS
Sales results will be available post sale on the Web. If Auction Floor Bidder is recorded as the winner, either the piece has not met its reserve and was bought in-house, or an absentee/phone bidder has won the item.

VI. PREVIEW
Many of our items are on site, however some are not. Please call at least 24 hours in advance to set up a preview. We strongly urge potential bidders to preview items if condition of an item is a concern. It is the bidder's responsibility to know the condition of the item.

VII. BUYER'S PREMIUM, TAXES, AND PURCHASE PRICE
A buyer's premium of 20% will be applied to the purchase price of all the items bought through live Internet bidding, absentee bidding, and phone bidding.

All items shipped out of state do not pay New York State taxes. If shipping items within the State of New York or picking them up from Showplace, regardless of your location, New York taxes will be applied. Only a valid resale certificate from any state as proof of exemption from New York sales tax is allowed.

VIII. PAYMENT
All payments from online bidders are due within 3 days of receipt of the invoice. unless otherwise arranged. All payments from absentee and phone bidders are due within 3 days of receipt of the invoice.

We prefer PayPal as the most efficient and dependable form of payment. Please email info@nyshowplace.com for payment by PayPal. We also accept all major credit cards, cash (in-house only), and checks. We hold all goods paid for by check until the payment has cleared.
