CONDITIONS OF SALE
Each lot is sold as is. Any description issued by the auctioneer of an article to be sold is subject to variations to be announced in the auction room prior to the time of sale. An opportunity for inspecting each lot is offered prior of the time of sale. All photographic representations and other illustrations presented in the catalogue or website are solely for guidance and are not to be relied upon in terms of tone or colour and do not necessarily reveal any imperfections in the lot. All statements or representations of lots, whether printed in the catalogue, illustrated in the website or made orally, are only opinions and are not certifications. Cosner Gallery, its employees and agents are not responsible for the correctness of any statements regarding the authorship, origin, date, medium, attribution, genuineness, or provenance of any lots.
The auctioneer is absolutely free to divide, combine or withdraw any lot or property before the sale, to refuse or reject the offers and bids to lead. The auctioneer is entirely free to make offers to bid on behalf of the vendors and consignees or when lots that have minimum « reserve » price at its sole discretion.
The auctioneer reserves the right to refuse and to reject any bid. Without limitation, any bid which is not commensurate with the value of the lot offered, or which is merely a nominal or fractional advance to the instructions may be rejected.
Each lot may be subject to an unpublished reserve which may be changes at any time by agreement between the auctioneer and the consigner. The auctioneer may bid on behalf of the consignor as agreed between them. In addition, the auctioneer may accept and submit absentee bids pursuant to the instructions of prospective buyers not in attendance at the sale.
The auctioneer reserves the right to refuse admission to the sale or to refuse to recognize any or all bids from a particular person at any auction sale.
A premium of 17% of the successful bid price of each lot is paid by the buyer as part of the purchase price.
The highest and last bidder acknowledged by the auctioneer will be the buyer. In case of disagreement between bider or if the auctioneer is in doubt about the validity of an offer, the auctioneer is to decide or determine who is the buyer, re-list the lot in question, or withdraw it. In case of dispute after the sale, our sales record will take the decision. Payment will only be complete when the checks have been deposited or the authenticity of money orders or certified checks has been verified. Payment methods accepted are Visa, MasterCard, check, debit, cash.
At the stroke of the auctioneer's hammer, title shall be transfers to the highest and last bidder acknowledged by the auctioneer, subject to the conditions herein.
Immediately after a lot is auctioned, the buyer is responsible for any items purchased and assumes all risks. Although Cosner Gallery will take the necessary precautions for the preservation of the lots, it will not be liable for damages that do not result from negligence.
If the buyer has any doubts regarding the authenticity of an original painting, Cosner Gallery shall allow a period of 14 days during which the authenticity of the painting can be verified. If certificates by two art experts recognized by the Cosner Gallery confirm that this is not an original work, full refund will be made provided that the said certificates are delivered to the auctioneer within 14 days following the auction. After 14 days, any sale of original paintings will be final and binding on the purchaser.
Cosner Gallery reserves the right to publish the lots sold and prices awarded after the auction for promotional purposes. Cosner Gallery also reserves rights to publish after the auction, pictures and images of any lots sold and unsold at the auction.
PAYMENT CONDITIONS
Immediately after the purchase of a lot, the buyer shall pay or make an agreement to the satisfaction of the auctioneer with respect to payment in whole or in part of the purchase price requested by the auctioneer, failing which the auctioneer, at his sole discretion, may cancel the sale, whether or not the item is re-offered for sale. If the buyer fails either to pay or to take away any lot within 7 office days form the auction sale date, the auction house may, at its absolute discretion, be entitled to one or more of the following remedies without further notice to the buyer and without prejudice to any other rights the law makes available:
- cancel the sale and retain as liquidated damages any deposit payment made by the buyer;
- resell the lot at a public auction or privately. The buyer will be responsible for any deficiency, costs, or expenses incurred in the sale;
- require the payment of any charge incurred by the auctioneer for the storage of such articles until payment and removal by the subsequent buyer; or
- require the amount of the commission which the auctioneer would have earned had payment been made in full by the original buyer.
Shipping Terms
The buyer shall collect the lot from the auction house offices within 7 office days from the auction sale date, after which date the buyer is responsible for all expenses (representing 2% per month on the total invoice amount) until the date the lot is removed from the offices of the auction house. Failing payment' the auctioneer, at his sole discretion, may cancel the sale. The buyer shall not become the owner of the lot until paid in full.
It is the buyer's responsibility to make all arrangements, at his own charge, for insuring, packing and removing the purchased property. Any assistance by the auctioneer in packing or removal shall be rendered as a courtesy and without liability to the auction house. The auction house shall not be liable for any damage to the lot (including glass and frame) or for any errors, omissions, or damage caused by a packer or shipper, whether or not such agent was recommended by the auction house.
TAXES CONDITIONS
The buyer shall pay the federal goods and service tax and provincial sale tax applicable on the hammer price, including the commission fee of 17% upon payment, unless a PST /GST exemption number is shown, except for purchases exported from Canada. In the case where purchases are shipped out of the province of Quebec, the HST or GST is charged based on the tax status of that province.

- It is understood that Cosner Gallery executes absentee bids as a convenience for its clients and is not responsible for inadvertently failing to execute the bids or for errors relating to their execution of the bids. On the bidder's behalf, Cosner Gallery will try to purchase these lots for the lowest possible price, taking into account the reserve and other bids. If identical absentee bids are received, Cosner Gallery will give precedence to the absentee bids from received first. It is understood that all successful bids are subject to the terms and conditions written in the Cosner Gallery Auction catalogue and website.
- It is understood that for any successful bid, the purchase price shall be the hammer price plus a buyer's premium of 17% and applicable taxes.
