Terms and Conditions

The buyer agrees to pay us, in addition to the hammer price of the lot, the buyer's premium and any applicable sales tax (the "Purchase Price"). The buyer's premium is 23% of the hammer price.

Sales tax, use tax and excise and other taxes are payable in accordance with applicable law. All prices, fees, charges and expenses set out in these Conditions of Sale are quoted exclusive of applicable taxes. Bal Harbour Auctions will only accept valid resale certificates from US dealers as proof of exemption from sales tax. All foreign buyers should contact the Client Accounting Department about tax matters.


Seller with contact the Buyer within three (3) days of the completion of the auction. Complete payment is due upon receipt of notification of a successful bid and must be done by the Buyer no later than 7 days after an invoice is received. Title shall pass to the Buyer once payment in full has been made. All shipping charges will be borne by the Buyer. Any item that has not been paid within 7 days after the receipt of the notification may be put back on the auction block for sale. Any buyer that does not make payment will automatically be blocked from future auctions and will be filed with a collection agency and the credit bureau.


As a courtesy to clients, Bal Harbour Auctions will accept American Express, Visa and MasterCard to pay for invoices of $10,000 or less. A processing fee will apply. Any payment of more than $10,000 must be made with a wire transfer. International purchases must be paid by wire transfer only.
Title in a purchased lot will not pass until Bal Harbour Auctions has received the Purchase Price for that lot in cleared funds. Bal Harbour Auctions is not obliged to release a lot to the buyer until title in the lot has passed and appropriate identification has been provided, and any earlier release does not affect the passing of title or the buyer's unconditional obligation to pay the Purchase Price.

Unless the buyer has delivered a valid certificate evidencing exemption from tax, the buyer shall pay applicable Florida sales tax on any lot picked up or delivered anywhere in the states of Florida.

As a courtesy to clients, Bal Harbour Auctions will, without charge, wrap purchased lots for hand carry only. We will, at the buyer's expense, either provide packing, handling, insurance and shipping suggestions to facilitate such services for property bought at Bal Harbour Auctions. Any such instruction, whether or not made at our recommendation, is entirely at the buyer's risk and responsibility, and we will not be liable for acts or omissions of third party packers or shippers.


The highest bidder shall be the buyer and if any dispute arises between two or more bidders, the auction coordinator shall decide the buyer. We are not responsible for any technical issues or bids placed "by mistake"

The auction house reserves the right to refuse any sale due to unforeseen circumstances including, but not limited to: damage to an item, out of stock listing, misrepresented item, withdrawn consignment, or other such issues. In the event of a refused sale for which payment has already been received, a full refund will be issued equal to the purchase price of the given piece.

By signing up to bid with us, you consent to allow us to contact you via email about this auction, upcoming auctions, and to discuss any and all purchases.

All items in the catalog are sold as described and sales are final. Buyer has the right to contact us if the item is not as described for any reason. We reserve the right to cancel any sale.
