Conditions of Sale

1. As auctioneer's we contract as agents for the seller whose identity, for reasons of confidentiality, will not be disclosed.

2. The highest bidder shall be the buyer except in the case of a dispute. If during the auction the Auctioneer's consider that a dispute has arisen he has absolute discretion to re-oer or settle the lot.

3. All lots oered for sale are subject to any reserve price place by the vendor.

4. If within 28 days after the sale the buyer of any lot returns the item(s) to Charnwood Specialist Auctions in the same condition as at the time of the sale and satisfies Charnwood Specialist Auctions that considered in the light of entry in the catalogue the lot is a deliberate forgery the sale of the lot will be rescinded and the purchase price of the same refunded in full. In the event of a dispute the matter shall be settled by arbitration to be nominated by the President of the Royal Institution of Chartered Surveyors. The buyer and the vendor agree to be bound by the decision.

5. By making a bid for each lot, each buyer acknowledges that he has satisfied himself fully before bidding by an inspection, or otherwise, as to the sale conditions, the physical condition of and description of the lot including, but not restricted to whether the lot is damaged or repaired or restored.

6. Legal title shall not pass to the buyer until the lot(s) have been paid for in full. The Auctioneer shall be entitled to hold the lot(s) until payment has been made in full. Each lot is at the sole risk of the buyer from the fall of the hammer. Each buyer shall give his name and permanent address, and if required to do so by the Auctioneer, shall pay Charnwood Specialist Auctions a proportion of the sale price that the Auctioneer may require. No purchase can be claimed or removed until it has been paid for in full.

7. All lots up to the value of £50,000 are subject to a buyer premium at 15% of the hammer price plus VAT at 20% (on premium only). All lots above £50,000 are subject to a buyer premium of 10% of the hammer price plus VAT at 20%. An additional 3% charge will be added to all items purchased through invaluble & autionzip live bidding system (subject to VAT).

8. Royalty payments Artists resale royalty charge will apply to buyers on qualifying art work with a hammer price over Euro 1000.

9. We accept debit cards, credit cards and cash up to the value of £9,000. Please note credit cards and business debit cards are subject to a 3% surcharge.

10. All buyers to register prior to auction before purchase of any lot. Buyer to supply bank or other suitable references.

11. Payment for all lots is due immediately after the sale.


Online Bidding
We offer an online bidding service via invaluable & auctionzip for bidders who cannot attend the sale. In completing the bidder registration on www.invaluable.co.uk, www.invaluable.com, or auctionzip.com and providing your credit card details, and unless alternative arrangement are agreed with us, you:

1. Authorise us, if we so wish, to charge the credit card given in part of full payment, including all charges, for lots successfully purchased in the auction via invaluable or auctionzip, and

2. Confirm that you are authorised to provide these credit card details to us through invaluable or auctionzip and agree that we are entitled to ship the goods to the card holder address provided on fulfilment of the sale.

Please not that any lot(s) purchased via invaluable or auctionzip live auction service will be subject to an additional 3% charge plus VAT charged at 20%.
