Conditions of Sale
1. All property offered and sold through Artch Auctions shall be offered and sold with the terms and conditions set forth in these Conditions of Sale. By participating in any sale, bidders acknowledge that they are bound by these terms and conditions.
2. A buyer's premium will be added to the successful bid price and is payable by the purchaser as part of the total purchase price.
3. The buyer's premium varies depending on increments based on the final sale price. Buyer's premiums through Artch Auctions; 14% for final bids up to $1,000, 10% for final bids up to $5,000, and 9% for final bids above $5,000.
4. Please note that Invaluable charges an additional 5% to the Buyer's Premium for their services.
5. Be sure to factor in these buyer's premiums when determining your maximum bid.
6. Beyond each lot Description Artch Auctions assumes no risk, liability or responsibility for the identification, authenticity, authorship, weight, count, or measure of any property identified in its catalogue or lists of sale. This shall include, among others, the identity of the creator, the period, culture, source of origin, as the case may be, with which the creation of any property is identified in any publication.
7. No Description or Condition Report regarding condition, kind, value, or quality of a lot, whether made orally at the auction or at any other time, or in writing in this catalogue or elsewhere, shall be construed to be an express or implied warranty, representation, or assumption of liability.
8. All property is sold "As is."
9. Artch Auctions does not accept returns on the basis of condition or expected benign environmental wear. It is the buyer's responsibility to inquire as to the condition of a specific lot prior to bidding. Artch Auctions does not include condition reports in lot descriptions. Please email all condition requests to info@artchauctions.com and include all contact information. Condition requests are answered in the order received. Condition reports will not be given by telephone.
10. The deadline to submit condition report requests is 5:00 PM MST three days before the end of auctions. Condition requests placed on auction day are not guaranteed to be answered. Artchaucer reserves the right to close the Condition Report desk at any time.
11. Do not bid if you have not received a condition report and are unsure about the lot in question.
12. All potential buyers should be sure they have read and agree to the Conditions of Sale.
13. If you are interested in obtaining a shipping quote for a piece of artwork, please note that all dimensions contained in Artch Auction's descriptions apply to the art only and do not include the frame or packaging materials.
14. All sales are final.
15. Artch Auctions reserves the right to withdraw any property at any time before the end of the auction in its sole and exclusive discretion.
16. Upon the end of the auction, the winning bidder assumes full risk, insurance liability, and responsibility for the property sold, agrees to sign any requested confirmation of purchase, and agrees to pay the full purchase price including buyer's premiums and additional shipping charges within the time periods specified within these conditions.
17. Ownership of each lot will immediately pass to the highest bidder once payment has cleared at the bank.
18. All property not paid for or shipped within thirty (30) days of sale may be considered abandoned and can be sold by Artch Auctions, or sent to a public warehouse, at the sole risk and expense of the purchaser(s).
19. Items sold at auction subject to international, federal, state, or any other laws, regulations, restrictions, taxes and tariffs, regarding the licensing, importing, exporting, resale, transporting, conservation, are the prospective bidder's sole responsibility.
20. Any item not paid in full thirty days (30) past the closing of the sale is forfeited by the buyer and the item may be put back on the auction block for sale without refund.
21. Any buyer that fails to make payment will automatically be blocked from future auctions, filed with a collection agency and credit bureau(s).
22. Bidders with 3 recorded unpaid item strikes through Artfact will not be allowed to register to bid at Artch Auctions.
23. If the foregoing conditions or any applicable provisions of law are not complied with, in addition to other remedies available to the Artch Auctions and the Consignor (including without limitation the right to hold the purchaser(s) liable for the bid price), Artch Auctions, at its option, may either cancel the sale, retaining as liquidated damages all payments made by the purchaser(s), or resell the property. In such event, the purchaser(s) shall remain liable for any deficiency in the original purchase price and will also be responsible for all costs, including warehousing, the expense of the ultimate sale, and the Artch Auction 's commission at its regular rates together with all related and incidental charges, including legal fees.
24. Artch Auctions and Artchaucer LLC reserves the right to modify the Conditions of Sale at any time.
Contract

Buyers Premium

Payment Terms
1. Payment in U.S. Dollars is due within seven (7) days of the end of auction.
2. Bidder Credit Cards may be charged 4 days after an invoice has been sent.
3. Invoices are issued representing the total purchase amount due, including buyer's premiums, applicable taxes, and payment methods within 24 hours of the end of auction.
4. Acceptable forms of payment for winning bids up to $5,000 include VISA, Mastercard, American Express, PayPal, cash, cashiers checks, and wire transfer. Contact Artch Auctions for wire transfer information. In the case of a wire transfer, a $25 wire transfer fee will be added to the invoice.
5. Purchase balances over $5,000 may not be paid by credit card.
6. Purchases exceeding $25,000 must be paid by bank wire transfer. Wire transfer fees incurred by the buyer are the buyer's responsibility. When sales exceed $25,000 there is no additional fee on the receiving end of a wire transfer. Wire transfer instructions are sent out to winning bidders at the time of invoicing.
7. Lots purchased will not be released until funds have cleared the bank.
8. All payment methods will not be deemed to constitute payment until funds have cleared at the bank.
9. In the case of delayed payment, a reminder is sent and a late fee of 3% is charged. If there is continued delay in payment, Artch Auctions may demand the fulfillment of the contract of sale or claim damages for non-performance. The items can be placed in another auction and sold there. Any losses arising from this sale, such as the costs and fees of the new auction, will be charged to the defaulting bidder. With the listing of a new sale, the rights of the defaulting bidder from the previous auction are revoked.
10. If the buyer is delayed in the collection or shipping of their purchased item(s), a storage fee of ten dollars ($10) per lot per day plus applicable taxes will be charged. The collection of items placed in storage is only possible with a confirmed appointment.
11. The shipment of delayed payment items placed in storage with fees due requires payment in full before being released for shipment.

Shipping Terms
1. Packaging, shipping and insurance in transit is the sole responsibility of the buyer. For some sales an insured shipping charge will be added to invoices for ease and rapid processing. Contact us if you have questions.
2. Upon close of the auction buyer will receive invoicing with local shipping contact options available by request.
3. Buyer can expect rapid shipping following payments and shall make extra arrangements if required to ship all property within fourteen (14) days of sale.
4. Payment is a precondition to pickup, delivery, or shipping.
5. Merchandise will not be released until payment is received.
6. Shipping payment is the responsibility of the buyer and may be billed separately by the buyer's designated shipper and is separate from purchase price.
7. Upon completion of the transaction, please call or email a shipper of your choice; you may call one shipper to do the job but are also welcome to call several in order to get quotes. Please make sure this is clear to those you are calling. Contact Artch Auctions for a list of local shipping companies.
8. Pick up by transport companies or individuals require an appointment. Call Artch Auctions to schedule a pick up for large items if required.
9. Artch Auctions offers convenient, dependable, and skilled in-house art packaging and shipping at affordable and competitive prices. Artch Auctions always requires all items to be fully insured. Adult signature and delivery confirmation are required unless you waive signature required services.
10. On the 30th calendar day following the auction, all lots that have not been removed from Artch Auctions may be moved by Artch Auctions to an off-site storage facility and will incur storage fees of $10.00 per lot per day until removed.
11. From the end of the auction the buyer is responsible for insurance.
12. UPS, FedEx, and services provided by the gallery are available. Additional freight companies are available by request.
13. When calculating shipping charges keep in mind that the dimensions provided in item descriptions are without packing materials.
