Terms and Conditions
The Terms and Conditions contain the Conditions of Sale in the auction of Budapest Poster Gallery (Modernista Kft.) (hereafter: BPG). It describes all terms under which the posters are offered for sale. The conditions may be subject to change by any posted notice during the sale.
By participating in this auction all prospective Purchasers agree, understand and acknowledge these Terms and Conditions. The Purchaser declares that s/he will never plead that s/he was unfamiliar with this Terms and Conditions.
The conditions shall only be amended in writing.
The terms written in this Terms & Conditions are binding for both parties.
Authenticity and Terms of Guarantee:
All lots in this auction are used. BPG disclaims all liability for any defect of the quality of the lots. Legitimate complaints regarding such defects of quality have to be made within three days of receiving the purchased item. All lots are sold AS IS.
The sale is final after the lot in question has been auctioned. From the date of the sale BPG warrants the authenticity of the authorship of all posters on sale for two years. The warranty is only available for the original buyer (person or company), who purchased the poster at this auction, thus it is not transferable to anybody else.
The warranty is valid only if the poster is returned in the same condition as it was on the day of the purchase. In such case, the shipping fee has to be paid by the Purchaser. The Buyer has to prove beyond doubt that the author of the poster he brought is not as it was set in the online catalogue.
Any dispute regarding authenticity issues will be resolved by the competent Hungarian court. If the competent Hungarian court decides in favour of the Purchaser, the sale will be cancelled and the original purchase price together with the Buyers premium will be paid back to the Buyer.
Purchasing the lot does not equal to gaining copyright or reproduction right.
Minimum Bids:
Lots are offered for sale at the prices written next to each poster, unless a number of higher bids were done in advance in writing. Bids under the set price are not accepted. The bidding increments are previously set by BPG. Written bids have to be submitted at least one day prior to the end of auction. They will only be taken into consideration if they exceed other bids.
Auctioneers Discretions:
The auction will be conducted online on liveauctioneers.com. BPG reserves the right to split, combine or withdraw any of the lots or to disapprove or suspend bidders and regulate the bidding. The auction runs automatically on the liveauctioneers.com site. The winner of the lot is the bidder who offers the highest valid bid. The purchaser is, who will be the highest bidder, will be contacted by BPG after the sale.
BPG has the right to reject a bid if it is found inadequate for any reason. BPG has the right to withdraw or reoffer a lot in case this becomes necessary. If a dispute arises after the sale is considered final, the sale record of the auctioneer (BPG) shall be used as the evidence to prove the rightful owner of the purchased lot.
Order Bids:
BPG is executing bids in the name of those who are not able to participate in the live auction. The commission for an order bid has to be done in writing at least 1 day prior to the start of the auction. The order has to clearly state the personal details of the prospective Purchaser and the maximum bid s/he for the desired lot(s). BPG acts on behalf of the prospective
Purchaser and intends to buy the desired lot on the lowest possible price. However, BPG is not responsible for any mistakes or omissions related to the order bids. If the order is not clear or arrives late, BPG has the right to refuse bidding in the name of the Purchaser.
Lot Descriptions:
All goods are described in a state as they were in the allotted time.
The description of the lots consist of the following sections:
Artist: The name of the author of the object
Year: The date the object was printed (not necessarily the date of the event/film it promotes). If not known precisely, than a decade is provided.
Size: Sizes are centimetres. The width first, the length is second.
Type: The printing method which was used to create the poster if known (lithography, offset, intaglio, etc.)
Condition:
Mint - perfect condition, almost no sign of use or handling.
Near Mint - unobtrusive very light fold marks or unfolded, very small tears, minor creasing, no paper loss.
Fine - unobtrusive light fold marks or no fold marks, no or minimal paper loss, small tears, light creasing.
Very Good - fold marks, small to medium tears, creasing, small repairable paper loss.
Good - strong fold marks, possibly some paper loss, creasing, stains.
Before you buy a lot, we will gladly provide every information about the condition of the selected item if you contact us.
All posters are unbacked, unless stated otherwise.
Condition reports are only approximations, and BPG does not take responsibility for mistakes and inaccuracies in the condition description. Any discrepancy related to the condition of the purchased item does not provide grounds for the cancellation of the sales. However, blemishes, light creasing or tears which do not affect the basic image of the lot should not influence the value of the lot.
We encourage our bidders to contact us for detailed information about the lots the intend to bid on. We will provide high resolution detail photos and detailed descriptions, and will gladly answer all questions regarding any of the lots in the sale.
In the online catalogue, we provide at least one photo of each lot. We are keen on making as accurate photos and descriptions as possible. However, we can provide photos of the desired items in high resolution upon request. Such requests shall be done in e-mail, minimum 1 day before the action starts.
Payment:
Ownership of the purchased item will go to the Buyer when the full purchase price has been paid.
On the ending of the timed auction the Purchaser agrees to pay the following:
FedEx shipping is free. Purchaser pays extra the shipping, handling and storage fees for unusually large, heavy, fragile lots.. Paying the full purchase price is due in 14 business days after the sales. If the payment happens within the set deadline the final fee consists of the following:
- The final purchase price of the lot announced upon the end of the timed auction.
- Invaluable's 3% commission added to the total.
- Purchase is VAT free for countries outside the European Community (EC). It is also VAT free for companies within the EC if they have an EU VAT number. For citizens of the EC a 27% VAT fee has to be paid unless they make the purchase as a company.
- Shipping and handling fee for unusually large, heavy, fragile lots: If payment does not happen within the set deadline, it's all the risk and expense of the Purchaser.
In such case, BPG stores the purchased lots for the following fees, which have to be paid until the item is removed from BPG:
- The storage and handling fee is 2% of the purchase price/month/lot.
- A minimum fee of 5% of the purchase price if the purchased lot is not removed within 30 days following the sales.
- 2% of purchase price is charged/month as a late charge. In any case the Purchaser is responsible for paying the shipping, handling and storage fees. Payments have to be made with bank wire transfer or PayPal or in cash at the gallery.

Credit card payment: If you wish to pay with a credit card, we will send you a payment request email with PayPal, which will contain a link with which the Buyer can make the payment with a credit card.

The purchase price can be paid in US Dollars, Euros, British Pounds or Hungarian Forints.
Delivery:
The purchased lot will only be shipped after the payment of the full purchase price has been made. If BPG is unable to ship the purchased lot for any reason, is liable for refunding the paid fee to the Purchaser and to rescind the sales, but is responsible for nothing else. If the lot is damaged to any extent caused by the shipping procedure, BPG is not liable.
Shipping:
In most cases, BPG offers FREE FedEx priority shipping worldwide.
Posters are safely packed in multiple tubes.
Unless otherwise agreed, BPG ships the purchased item with FedEx Priority Service. If the Purchaser prefers any other method, alternative shipping methods can be used at the expense of the Purchaser. Please contact us with any questions regarding shipping methods and fees for unusual items in terms of size, fragility, etc.
Estimated Value:
All lots have a start price under which bids are not accepted.
In the online catalogue three prices are listed for each lot. The start price, minimum and maximum estimates are indicated. The estimates show an estimated market value of the lot. This market value is purely a guideline and should not be relied upon. It is the estimation of the fair market value of the lot in the condition it is at the time of the auction.

In case of failing to comply these terms and conditions:
If the Purchaser fails to comply to the conditions set in this Terms & Conditions, BPG reserves the right to cancel the sales without notice to the Purchaser. In such case BPG shall retain all fees paid by the Purchaser as liquidated damages, or sell the item/s bought by the Purchaser without notice.
If a judicial proceeding becomes required for any reason, Budapest, Hungary is the deemed place for such events.

Shipping Terms
Shipping and Delivery
Some small items will be wrapped & boxed at our facility for a minimum handling fee of $5. Multiple purchases may be boxed together for the $5 minimum. Packages are then taken to the USPS and shipped once payment has been received. We pay for the shipping, and get reimbursed by the buyer via a second billing on your card for shipping & handling.
Insurance is required on all shipments.
You can pick up items at our facility, but a pickup time must be arranged first - at least a 1 day notice please. There are no additional costs if you are picking up goods. No items will be released until paid in full. You must show a paid receipt before items will be released.
All items are sold in AS-IS condition. There are NO REFUNDS or EXCHANGES, ALL SALES ARE FINAL. Please view the photos and description of the item before bidding, or contact Auction Company for more info.
If problems do arise, please contact us, and we will do our best to resolve any issue.
Pinnacle Auction is not responsible for any delays regarding deliveries. It is YOUR RESPONSIBILITY to have the correct address & contact info on file. We will provide assistance in following up status of deliveries but we will not be held responsible for third party handling. Any item not picked up or shipping arrangements made within 10 working days after the auction will be resold for storage fees regardless of payment status.
