Conditions of Auction
The following "Conditions of Sale" are Daniel Buck Auctions, Inc. and the Consignor's Agreement with the Buyer relative to the property listed in the Auction Catalog. The glossary and all other contents of the catalog are subject to amendment by Daniel Buck Auctions, Inc.by the posting of notices or by oral announcements made during the sale. All properties offered by Daniel Buck Auctions, Inc.as agent for the Consignor unless the catalog indicates otherwise.
By participating in a Daniel Buck Auctions, Inc. sale, the Consignor, Bidder and Buyer agree to be bound by these Terms and Conditions.
1.) BEFORE THE SALE. Except for Online only auctions, all lots are available for inspection before and up to the beginning of the sale. Condition Reports are not included in the catalog description, but can be requested by contacting Daniel@DanielBuckAppraisals.com. Any prospective bidder is encouraged to contact Daniel Buck Auctions, Inc. for any information regarding the condition of any lot. Daniel Buck Auctions, Inc. does not warrant the condition of any item. Any potential Buyer who is interested in the condition of an item, are encouraged to contact Daniel Buck Auctions, Inc. and, to the best of our ability, we will document for the prospective bidder the condition status of any lot the buyer is possibly interested in. All Property is sold "AS-IS, WHERE IS, ALL SALES FINAL" without recourse, and neither Daniel Buck Auctions, Inc. nor the consignors make any representations or warranties, expressed or implied, as to the catalog description, attribution, authenticity, provenance, origin, size, age or condition of any of the property offered. It is the responsibility of the purchaser, prior to the auction, to examine the property and determine on their own all of the above. If requested of Daniel Buck Auctions, Inc. prior to the sale and in a timely manner and when possible, Daniel Buck Auctions, Inc. will offer an "opinion" on condition and authenticity but this does not relieve the buyer from responsibility to personally inspect the property they are possibly interested in purchasing, prior to the auction. All measurements and weights offered in the catalog are approximate. The buyer must offer prompt payment and shipping arrangements. NOTE: If you are planning to purchase a Firearm(s), and your domicile is any state other than Maine, be sure that you are able to purchase, or take possession of, the firearm(s) that you are planning to bid on in your state. If you are the successful bidder and you are not allowed to take possession in your state of residence of the firearm that you bid on, you will still be responsible to pay the Buyer's Premium to the auction house.
2.) HIGHEST BIDDER. The highest bidder at the completion of each item sold will be acknowledged by the auctioneer and the auctioneer ONLY. After such acknowledgment, title passes to the successful bidder. The bidder thereupon assumes full risk and all responsibility for the property, including the obligation to pay the full hammer price, buyer's premium, and if applicable, internet fees. All potential bidders must register before the auction and sign a bidder registration form. Daniel Buck Auctions, Inc. shall have the right to reject any bid from anyone, including, but not limited to, those who have not established credit prior to the auction in a timely manner.
3.) BUYER'S PREMIUM. A Buyer's Premium will be added to the hammer price of each lot. The Buyer's Premium is 13%, 10% if paid by Cash or good Check. Also, there will be a 5% additional charge on all purchases made through the internet.
4.) PAYMENT. Unless previous arrangements have been made with Daniel Buck Auctions, Inc., payment with good funds is due at the completion of the auction for bidders attending the sale including 5.5% Maine Sales Tax unless we have a copy of a buyers resale certificate on file. All Absentee, Online and Telephone bidders must pay for all purchases in full with cleared funds within five (5) days of the sale. All purchasers, both foreign and domestic, with total purchases being under $1,000 may pay by MasterCard or Visa. Daniel Buck Auctions, Inc. reserves the right to hold all property until funds have cleared through our bank. If payment is not received in full within thirty (30) days of the sale, Daniel Buck Auctions, Inc. will charge 1.5% monthly interest charge due on the date and the anniversary of the first day of the next thirty (30) day cycle. There also will be a $25 Transfer Fee for each of the modern firearms sold in this auction.
5.) PROPERTY PICK UP. Successful bidders must pick up all property within five (5) days of the sale unless other arrangements have been made with Daniel Buck Auctions, Inc. All packaging and shipping is the responsibility of the purchaser. Daniel Buck Auctions, Inc. will assume no responsibility for damage to property not picked up within that time period. Storage charges may be applied for items not picked up within that time period. All Firearms sales will be subject to Federal background checks, with no exceptions.
6.) NON-PAYMENT. If the purchaser fails to fulfill any of the above Conditions of Sale, in addition to all legal remedies available, Daniel Buck Auctions, Inc. may at its sole discretion: a.) cancel the sale and retain any and all payments made as liquidated damages, b.) resell the property at public auction or privately for the account of the buyer, in which case the buyer shall be liable to Daniel Buck Auctions, Inc. for all of its costs and damages, including the commission for both sales and any shortfall if the property sells for less than originally sold for, c.) remove the property to a public warehouse at the expense , and at the risk, of the buyer.
7.) RESERVES. Some lots do carry reserves or minimum selling prices. This is an amount agreed upon by the consignor and Daniel Buck Auctions, Inc. below which a lot will not be sold. Daniel Buck Auctions, Inc. will execute these reserve bids. The reserve will be at or below the low estimate, but estimates can be changed either in writing or verbally by the auctioneer at any time prior to the offering of each lot.
8.) TELEPHONE BIDS. If you are willing to open a lot for at least 50% of the low estimate, we suggest you place an Absentee Bid. Bids above those amounts will be executed for you competitively. Please note that errors may occur with telephone bids for a number of reasons including, but not limited to, cell phones that are out of calling range and busy signals. Under absolutely no circumstances will Daniel Buck Auctions, Inc. be responsible for problems incurred with telephone bidding.
9.) REGISTERED BIDDERS. As a registered bidder you agree that any legal action that is brought against Daniel Buck Auctions, Inc. or any of its employees and officers will be brought in the courts of the State of Maine or a Federal court sitting therein.
10.) ENDANGERED SPECIES. Certain lots may contain materials from animals considered to be endangered species. It is the responsibility of the purchaser to make sure that shipment to their location is allowed.
11.) BIDDING. Bidding on any item at Daniel Buck Auctions, Inc. indicates your acceptance to these terms and any and all terms announced before or at the time of the sale whether bidding in person, by absentee bid, by telephone or by online bidding.
12.) ABSENTEE BIDDERS. Unless known to Daniel Buck Auctions, Inc., absentee bidders must supply at least two (2) references from other American auction houses, a fax number and a credit card number prior to the sale. Statements will be mailed the next business day after the sale and payment upon receipt of that statement is requested. Payment must be received within 15 calendar days of the date of the sale or a service charge will be charged at 1.5% at that time and on the start of each additional 30 day period.
13.) MAINE AUCTIONEER RULES AND REGULATIONS. The Maine Auctioneer Rules and regulations are regulated by the Maine Board of Licensing of Auctioneers, 35 State House Station, Augusta, Maine 04333. 14.) SAFETY. Neither Daniel Buck Auctions, Inc, their consignors, employees or agents warrant the safety or the shootability of any firearm in this auction. All firearms in this auction are sold as is, where is and as collectors' items. Should you wish to attempt to shoot any of the firearms in this auction, you must have the weapons examined by a competent gunsmith who will test the weapon for its shootability and also to ensure that the caliber of the breech is in fact the caliber that is thought to be.

TERMS: Cash or Good Check. A Buyers Premium (as described in item #3 above) will be added to the hammer price to those buyers using a credit card. All offerings subject to error. All goods sold "As Is, Where Is, all sales final". Absentee and Telephone bids are executed as a courtesy and Daniel Buck Auctions will not be held responsible for any errors or failure to execute bids. All other conditions of sale as stated in the auction catalog apply.
