CONDITIONS OF PURCHASE

1. The auction will be conducted by Stein Rose Fine Art LLC (Stein Rose) and/or an auctioneer appointed by Stein Rose.

2. Stein Rose is acting as broker between seller and buyer and on behalf of the consignor.

3. All lots are sold "as is". Neither Stein Rose nor the seller makes any express or implied warranty of any kind with respect to the description, attribution, literature, period, provenance, condition and/or frame concerning the lots offered in the auction. No statement in the sale nor the invoice nor the bill of sale given to purchasers shall be deemed such a warranty.

4. It is the responsibility of the bidder to examine the work and confirm authenticity prior to bidding.

5. The prices quoted in the catalogue are estimates as assessed by Stein Rose representatives.

6. Items may be subject to a reserve price, below which the auctioneer is not entitled to sell. The reserve price may not be higher than the low estimate, yet it may be lower. The auctioneer may open the bidding at an amount equal to or below the reserve price and may place consecutive bids on behalf of the consignor until the reserve price is met.

7. Stein Rose may withdraw any lot or lots from the sale prior to the auction according to its sole judgment.

8. The auctioneer is the sole authority to determine the winner.

9. The auctioneer may withdraw or postpone the offering of any lot at any time including during the auction. He may re-offer and/or resell it, all according to his sole judgment, including yet not limited to prior to the auction, during the auction, and following the auction. It is the auctioneer's sole judgment to reopen a lot and/or to cancel a sale.

10. Auctions are conducted in U.S. dollars. Payment is in US dollars.

11. All potential bidders who wish to participate in the auction must register prior to bidding. Stein Rose will not accept third party payments.

12. Absentee bidders authorize Stein Rose to represent them and to bid on their behalf at the time of auction in the interest of purchasing.

13. The purchaser is irrevocably committed to pay for the item and to accept it. The auctioneers and/or Stein Rose may take any measures necessary for realizing the fulfilment of this commitment.

14. The hammer price represents the price for the item which the auctioneer is to collect for the consignor.

15. To the hammer price will be added a buyer's premium of 25% for sums up to and including $50,000 hammer price, and 20% on hammer price of sum beyond $50,000.

16. In addition to the hammer price and buyer's premium, the buyer is responsible for all relevant taxes including yet not limited to Sales Tax, Value Added Tax, Use Tax, etc.

17. All expenses relating to the purchase of a lot including yet not limited to, packing, forwarding, insurance from time of purchase, etc., will be borne by the buyer. It is the responsibility of the buyer to insure his purchase within three days after sale. Should the high bidder wish, he may inform Stein Rose to insure the work on his behalf and at his expense.

18. Payment for the article, plus the buyer's premium, plus relevant taxes plus additional expenses must be paid in full immediately yet not later than seven business days following the date of sale.

19. Acceptable forms of payment include checks drawn on US banks, money transfers and credit cards. All bank fees and credit card fees in regards to payment are the responsibility of and at the expense of the buyer. Please contact a Stein Rose representative for more information.

20. Final date for collecting of purchases is 14 business days following date of auction. However, no item will be released until full payment has been received by Stein Rose to cover all outstanding sums owed by the buyer to Stein Rose.

21. Following final date of collection all expenses incurred in regards to storage of the item(s) shall be paid by buyer and prior to release of item(s).

22. All sales are final.

23. The laws governing the auction are as according to those applicable at the location of the auction.
