The sitter was the fifth son of Montague Bertie 2nd Earl of Lindsey and his wife Margaret, daughter of Sir William Cokayne. He served as envoy to Denmark in 1671 and Secretary to the Treasury in 1673. He married Mary daughter of Peter Tryon. Their daughter Elizabeth married the 18th Baron Fitzwalter.

Hayls worked extensively for the Bertie family. The sitter's borther Henry was painted by the artist as well has his sister Mary (sold Sotheby's 21st March 2001, lot 35). A similar portrait of the sitter, in a private collection, is inscribed on the reverse: 'Copied from original canvas...Done by Hales'.
