Conditions of sale

auction e vente SAS est une société de ventes volontaires de meubles aux enchères publiques régie par la loi n° 2000-642 du 10 juillet 2000.
En sus du prix de l'adjudication, l'adjudicataire (acheteur) devra acquitter par lot les commissions suivantes :
- 20 % HT + TVA au taux en vigueur, soit 23,92 %TTC
- Lots en provenance hors U.E (seront indiqués par une astérisque dans le catalogue) : il convient d'ajouter la TVA à l'importation, (5,5 % du prix d'adjudication ou 19,6 % suivant les biens) aux commissions et taxes indiquées ci-dessus.
La vente est faite au comptant, pour l'intégralité du prix, des frais et taxes, même en cas de nécessité d'obtention d'une licence d'exportation.
L'adjudicataire d'un bien est le plus offrant et dernier enchérisseur. Il ne devient propriétaire dudit bien qu'après paiement à auction e vente du prix d'adjudication et des commissions, frais, droits et taxes s'y rapportant.
L'adjudicataire est responsable du bien qu'il vient d'acquérir dès le prononcé et l'adjudication et, à ce titre, prend à sa charge l'ensemble des risques afférents au dit bien dès cet instant.
Aucun bien ne sera délivré avant le paiement de l'intégralité des sommes dues pour le bien acquis.
Une exposition préalable permettant aux acquéreurs de se rendre compte des biens mis en vente, il ne sera admis aucune réclamation une fois l'adjudication prononcée notamment pour les accidents et restaurations d'usage.
Les dimensions et les estimations sont données à titre indicatif.
Mode de paiement
Virement bancaire en € :
Carte bancaire Visa ou MasterCard sur présentation d'un justificatif d'identité. L'identité du porteur de la carte devra être celle de l'acheteur.
Espèces :
jusqu'à un montant égal ou inférieur à 3 000 € pour les particuliers ayant leur domicile fiscal en France ou s'ils agissent pour les besoins d'une activité professionnelle;
En espèces jusqu'à un montant égal ou inférieur à 15 000 € : pour les particuliers qui n'ont pas leur domicile fiscal en France, ou s'ils n'agissent pas pour les besoins d'une activité professionnelle.
Chèque bancaire certifié en €UROS avec présentation obligatoire d'une pièce d'identité en cours de validité.
Les chèques tirés sur une banque étrangère ne seront pas acceptés.
Les chèques et virements bancaires seront libellés en euros à l'ordre de auction e vente SAS.
Exportation du bien
L'exportation de tout bien hors de la France peut être soumise à l'obtention d'une autorisation d'exporter que ce soit dans un état membre ou hors de l'union européenne.
Il est de la responsabilité de l'acheteur d'obtenir l'autorisation d'exportation.
Défaut de paiement
Conformément à l'article 14 de la loi n° 2000-642 du 10 juillet 2000, à défaut de paiement par l'adjudicataire, après mise en demeure restée infructueuse, le bien est remis en vente à la demande du vendeur sur folle enchère de l'adjudicataire défaillant ; si le vendeur ne formule pas cette demande dans un délai d'un mois à compter de l'adjudication, la vente est résolue de plein droit, sans préjudice de dommages et intérêts dus par l'adjudicataire défaillant.
auction e vente SAS peut réclamer à l'adjudicataire défaillant : des intérêts aux taux légal, le remboursement des coûts supplémentaires engagés par sa défaillance, le paiement du prix d'adjudication ou la différence entre ce prix et le prix d'adjudication en cas de revente s'il est inférieur, ainsi que les coûts générés par les nouvelles enchères. La différence entre ce prix et le prix d'adjudication sur folle enchère s'il est inférieur, ainsi que les coûts générés par les nouvelles enchères. auction e vente SAS se réserve également le droit de procéder à toute compensation avec les sommes dues par l'adjudicataire défaillant.
Droit de préemption
Il est rappelé que l'État français dispose d'un droit de préemption sur certains objets (œuvres d'art, archives...). Ce droit peut être exercé au cours de la vente et doit être confirmé dans les 15 jours qui suivent la date de la vente concernée. La confirmation de ce droit dans les délais emporte subrogation de l'État français à l'adjudicataire.
Ordres d'achat et enchères par téléphone
Les ordres d'achat se font par écrit à l'aide du formulaire prévu à cet effet en fin de catalogue ou sur place.
Ce formulaire doit être adressé à auction e vente SAS au plus tard 2 jours ouvrés avant la vente, accompagné d'un RIB bancaire précisant les coordonnées de l'établissement bancaire et d'une copie de pièce d'identité de l'enchérisseur.
Pour les achats importants, il pourra être demandé une lettre accréditive de la Banque ou .
Dans le cas de plusieurs ordres d'achat identiques, le premier arrivé aura la préférence.
Les enchères par téléphone sont admises pour les clients qui ne peuvent se déplacer. À cet effet, le client retournera à auction e vente SAS le formulaire susvisé dans les mêmes conditions. Les enchères par téléphone ne sont recevables que pour les lots dont l'estimation basse est supérieure à 300 €.
auction e vente SAS, ses représentants ne porteront aucune responsabilité en cas d'erreur ou omission dans l'exécution des ordres reçus, comme en cas de non-exécution de ceux-ci.
Direction de la vente
La personne habilitée à diriger la vente l'organise de façon discrétionnaire afin que son déroulement soit conforme à celui qu'elle juge acceptable.
À ce titre, elle peut notamment faire connaitre à l'ouverture ou au cours de chaque vacation des modalités particulières de la vente et des enchères, enchérir au nom et pour le compte du vendeur à concurrence du prix de réserve, refuser toute enchère qui dérogerait aux dispositions légales et règlementaires ou aux présentes conditions, diviser, réunir ou retirer tout objet ou tout lot, désigner l'adjudicataire, annuler la vente ou la poursuivre en cas de contestation ou d'erreur pendant ou après la vente.
Restitution des objets achetés
Les objets adjugés sont à la disposition de l'adjudicataire après paiement sur rendez-vous, sans frais pendant les 14 premiers jours.
Restitution des lots non-vendus
Les objets passés en vente et non vendus sont à récupérer sur rendez-vous

General terms and conditions of sale
Auction e Vente is an auction house specialised in moveable property governed by French Act no. 2010-741 of July 10th 2000.
Auction e Vente acts as the seller's agent. The auctioneer is not a party to the sale agreement, which is solely binding on the seller and the successful bidder.
General terms
Buyer's premium
The buyer must pay Auction e Vente, in addition to the "hammer price":
23,92 % inc.tax (20% +VAT 19,6 %)
For books : 21,10 % inc.tax (20% +VAT 5,5 %)
Lots preceded by an asterisk * (temporary importation) are subject to an additional premium of 5,5% of the hammer price, 19,6% for jewelry.
These taxes will be charged to the buyer who can claim a possible refund of these additional expenses and of this VAT if the property is exported outside the EU or if it is shipped to another EU country (refund of VAT only on the buyer's premium in that case) on presentation of written proof of exportation.
These general terms and conditions of sale, the sale and all matters relating there to are governed by French law; the sellers, buyers and their agents accept that the courts of Paris (France) alone shall have juridiction over any legal action.
These general terms and conditions are independent.
Purchases must be made in cash and prices are stated in euros (€).
As soon as an item is pronounced "sold", it shall be placed under the sole responsibility of the buyer.
It shall be the buyer's responsibility to insure the item purchased immediately.
The lots are sold in their current condition. Inasmuch as buyers are given the opportunity to examine works displayed prior to the sale, no claim may be made after the sale is complete
Payment
Payment must be made immediately after the sale.
If the successful bidder did not register before the sale, he/she must provide proof of identity and bank references.
Payments may be made by one of the following methods:
• Bank transfer in euros,
• Visa card or Master Card (subject to the presentation of valid proof of identity),
• French citizen may pay up to in cash : €3 000 inclusive of costs and taxes per sale
• For foreign citizen on presentation of their identity paper : up to €15 000 euros inclusive costs and taxes
• Trade clients may pay up to €750 inclusive of costs and taxes per sale in cash,
• Certified banker's draft in € subject to the presentation of valid proof of identity.
Cheques drawn on a foreign bank will not be accepted.
Cheques and bank transfers must be denominated in euros and made out to the order of Auction e Vente SAS;
Buyers may only take possession of items sold after Auction e Vente has received full payment of the sale price and the related commission and costs.
Import and export
The import and export of goods may be subject to authorisation (export certificates, customs authorisations). It is the buyer's responsibility to check which authorisations are required.
Non-payment
In accordance with Article 14 of French Act no. 2000-642 of July 10th 2000, if the successful bidder fails to pay for an item after the issuance of a formal demand that remains without effect, the item shall be re-auctioned at the seller's request. If the price of the new bid is lower than the original false bidder's price, the false bidder shall pay the difference. If the seller does not make such a request within one month of the auction, the sale shall be cancelled by operation of law, without prejudice to the damages payable by the false bidder.
Auction e Vente reserves the right to claim the following from the false bidder: interest at the statutory rate, the reimbursement of the additional costs incurred by reason of his/her default, payment of the sale price or: the difference between this price and the resale price if the latter is lower, as well as the costs incurred in relation with the re-auction., the difference between this price and the original false bidder's price if the latter is lower, as well as the costs incurred by the re-auction.
Auction e Vente also reserves the right to offset any amounts which the false bidder owes to it. - Auction e Vente reserves the right to ban any bidder who fails to comply with its general terms and conditions of sale from attending any future auction.
French State's right of pre-emption
The French State has a right of pre-emption in respect of certain works of art offered at auction. If the State wishes to exercise this right in respect of a sale, it must express its intention to do so within 15 days of the sale. In this case, the State shall be substituted for the last highest bidder.
Absentee bid forms and telephone bids
Absentee bid forms may be submitted using the special form provided at the end of the catalogue.
This form must be sent to Auction e Vente no later than two working days before the sale, together with a bank account identification slip ("RIB") and a copy of the bidder's proof of identity. For significant purchases, a buyer may be asked to provide a bank letter of credit.
If several absentee bid forms are submitted for the same item, the first order received will take priority.
Telephone bids may be placed by clients who cannot attend the auction. To this end, the client must return the above-mentioned form to Auction e Vente under the same conditions.
As there are only a limited number of telephone lines, the necessary arrangements must be made at least two working days before the auction.
In both cases, this is a service graciously provided free of charge to the client.
Auction e Vente, its employees, agents and representatives shall not incur any liability in the event of an error or omission in the execution of orders received or the non-execution of orders.
Bids
For the sake of the smooth conduct of auctions, bidders are asked to present themselves to Auction e Vente prior to the sale in order to register their personal data. Potential buyers must provide proof of their identity and bank references.
All individuals who register with Auction e Vente shall have the right to access and rectify the personal data they provide to Auction e Vente in accordance with the French Data Protection Act of 6 January 1978, as amended by the Act of 6 August 2004.
Auctions will be carried out following the order of the lot numbers as they appear in the catalogue. Auction e Vente is free to set the increment of each bid and all bidders must adhere to this process. The highest and last bidder will be the successful bidder.
In the event of a dispute during the bidding process, that is, if two or more bidders simultaneously place the same bid, either orally or by a signal, and each claim the item concerned when the auctioneer has declared the item "sold", the said item will be re-auctioned immediately at the price offered by the bidders and all those present may take part in this second auction.
Any individual who makes a bid during the sale shall be deemed to be doing so in his/her own name; he/she shall assume full responsibility for his/her bid, unless he/she registered him/herself as an agent with Auction e Vente and stipulated that the bid was being made for a designated third party.
In the event the seller sets a reserve price, Auction e Vente reserves the right to propose bids on the seller's behalf until such time as the reserve is met.
Warranties
The information included in the catalogue is prepared by Auction e Vente with the assistance of the Expert, if necessary, with the care required for public auctions, subject to the notices, declarations and amendments announced upon presentation of the item and noted in the record of sale.
This information, including the dimensions set out in the catalogue, is provided to help the potential buyer inspect items and must be assessed personally by him/her. If no information on restoration, an accident, retouching or any other incident is provided in the catalogue, the condition reports or labels or during a verbal announcement, this does not mean that the item is void of defects.
Collection of items purchased
The buyer may not take receipt of any lot until such time as he/she has paid all amounts due in full.
Furniture, paintings and large items sold that are not collected at the end of the sale shall be stored at the premises of of astorage indicated at the auction where they may be collected two days after the sale. Storage costs shall be invoiced to the buyer starting on the 15th calendar day from the date of the sale.
Items which are not collected within this time limit shall be stored at the risk and expense of the buyer.
All costs owed to the security firm must be paid prior to taking delivery of the goods.
In the event of a payment by cheque or bank transfer, delivery of the goods may be deferred until such time as the payment has cleared.
In this case, storage costs shall be borne by the buyer and Auction e Vente shall incur no liability whatsoever in this respect.
Collection of unsold items
The seller must collect any unsold items as soon as possible and in any case within 14 days of the auction.
The cost of storage shall be paid by the seller at the usual rate applicable in such matters.
Auction e Vente shall not be bound by any warranty vis-à-vis the seller in respect of such storage.
At the Sale
The auctioneer has the right at his absolute and sole discretion to advance the bidding in such a manner as he may decide, to refuse any bid, to withdraw or divide any lot and, in the case of error or dispute, and whether during or after the sale, to determine the successful bidder, to continue the bidding, to cancel the sale or to reoffer and resell the item in dispute. In any dispute arises after the sale, the auctioneer's sales record is conclusive.
Buyers are expected to pay for purchases immediately after the sale for the full sale price including fees and VAT, even if an export license is required. The person offering the highest bid is accepted by the auctioneer and will be the buyer. The striking of the hammer marks the acceptance of the highest bid and the conclusion of a contract of sale between the seller and the buyer. The buyer possesses the lot once he has paid auctionevente the full hammer price, the fees, VAT and commissions. The bid becomes the buyer's responsibility as soon as the bid has been accepted and on these terms, he accepts full financial responsibility and risks for the goods.
Please note that Internet bidder will pay 3% of Internet fee in addition to the final price including premium and taxes.
Payment
PAYMENT
Direct bank transfer in euros.
Debit or credit cards, Visa or Mastercard accompanied by a valid form of identification. The identity of the successful bidder will be the same as the identity of the person making the payment.
Cash:
Up to 3000€ for individuals with French fiscal residency, or if they are bidding on behalf of a company.
Up to 15,000€ for individuals who do not have French fiscal residency, or if they are not bidding on behalf of a company.
Certified bank cheques and guaranteed bank drafts drawn in euros and made payable to auction e vente, accompanied by a valid form of identification.
Checks drawn on a foreign bank will not be accepted.
Checks and bank wire transfers will be payable in euros to auctionevente SAS.
NON PAYMENT
As per article 14 of French law n° 2000-642 of 10th July 2000, if the buyer fails to make payment in full cleared funds within the time required, the lot will be put into another auction if the seller wants on the basis of "award to the successful bidder". If the seller does not request this solution within a month of the auction date, the sale is legally settled with no damage or fees due by the failed buyer.
auctionevente reserves the right to demand the following from the failed buyer: interest at the legal going rate, reimbursements of any extra costs due to his failed bid, the payment of the hammer price or the difference between the first hammer price and the amount at which the item is eventually sold at resale, if this happens to be less, as well as the costs entailed by new bids.
auctionevente also reserves the right to proceed with compensation regarding the amount due by the failed buyer.
