Description

This painting by Aboriginal artitst Bernard Tjalkuri is about a sacred place, Irmirka, where native quondong trees are found. Quondong is a type of Australian native peach. Men and women gather together to perform a ceremony associated with the quondong. There is also a big rock hole here. Bernard Tjalkuri is one of the most respected Elders from the APY region at the top of South Australia. He is considered to be one of Tjungu Palya's most collectible artists, and his works are represented in public museums, including the National Gallery of Australia and the Art Gallery of South Australia.

AGENCY. Galerie Zadra acts solely for and in the interests of the Seller.

PROPERTY IS SOLD 'AS IS' and as Final Sale. Galerie Zadra warrants that the provenance of the work is as stated in the catalogue. While we have made every endeavour to accurately describe each Lot, Galerie Zadra accepts no responsibility for any errors in the description of the works.

REGISTRATION. All bidders must be registered and approved to bid via the Invaluable platform. Each approved bidder will be issued with a paddle number.

SUCCESSFUL BID. The maker of the highest bid for each Lot at the conclusion of the timed auction and accepted by Galerie Zadra shall be the Buyer, which shall be deemed to be a contract of sale. Galerie Zadra reserves the right to refuse any bid. Any dispute shall be settled at Galerie Zadra's absolute discretion.

AUSTRALIAN RESALE ROYALTY. If applicable, a Note shall be made against each Lot to which an Australian Resale Royalty applies. Should a Resale Royalty apply, an amount of 5% of the total sale price including Buyer's Premium and applicable GST shall be added to the Buyer's invoice. Galerie Zadra shall be responsible for collecting and paying the Royalties to the Copyright Agency Limited (CAL), and reporting all Resales to CAL.

PURCHASE PRICE. The purchase price shall comprise the Hammer Price + Buyer's Premium. To this sum will be added Australian GST and Resale Royalty if applicable.

TITLE & RISK. Title shall not pass to the Buyer until the invoice has been paid and cleared in full. Risk - including loss and damage - in the Lot shall transfer to the Buyer either on the due date for payment, or on collection of the Lot, whichever is sooner.

Payment

The Buyer shall not receive Title in the work until the total invoice amount is paid. Payment by the Buyer shall be made within 3 days of receiving Galerie Zadra's invoice. Payment shall be in Australian Dollars by way of credit card, bank transfer or PayPal.

Buyer's Premium

The Buyer's Premium is 20%. It is calculated on the winning bid price and is payable by they Buyer to Galerie Zadra.

Australian Goods & Services Tax (GST)

For successful bids by bidders registered in Australia, 10% GST will be payable on the Buyer's Premium and added to the Buyer's invoice. Sales that are to be exported immediately from Australia are exempt from GST.
