Description

“ANA I”, 1964/2004; Folder "I" of the series of 4 published on the occasion of the exhibition at the Hummel Gallery in Vienna "Günter Brus. Aktionen 1964/65, 17. September – 27. November 2004. Photographs by Siegfried Klein (Khasaq). The original linen folder contains 12 silver gelatin printed photographs applied on original cardboard, each approx. 38 x 30 cm, cardboard 60 x 50 cm. On the back of each card the artist's signature, numbering (9 / I) and dry inscription (Günther Brus / ANA. Edition Sammlung Friedrichshof, Galerie Hummel Wien. Photographs in excellent condition, one with a slight abrasion at the top left edge . Provenance: Private collection

Conditions of Sale

The acceptance received the highest tenderer. The vendor is conditioned to pay the purchase price immediately after the acceptance in cash. Between the auctioneer and the purchaser, especially in case of museums and public institutions, divergent paying conditions can be agreed on. This is only possible, if agreed beforehand.

Prior to the auction there is a display of the objects. During this exposition you have organizers and experts at your disposal to answer possible questions regarding the status and the quality of the objects.

Potential buyers, which are prevented to view the objects during the display period, receive detailed information as well via phone. Next to that, there is the possibility to request detailed object descriptions. After a successful acceptance, any complaint on behalf of the buyer is legally excluded, even if during the drafting of the catalogue a mistake has occurred.

The auctioneer is entitled to undertake the auction sale divergent to the chronology of the catalogue numbers and respectively to divide, unify and withdraw lots.

Regarding the authorship and attribution of the objects in sale, the organization assumes warranty only in her function as commissary and in accordance with the legal terms following § 1705 ff.C.C. (Italian Civil Code). Possible contestations regarding an acceptance received during the auction, must be presented within a deadline of 8 days after the acceptance. The complaint entitlement must be examined on the basis of the generally accessible scientific findings and the opinions of universally recognized referees of the auction house and of a similarly qualified from the client proposed expert. Following the expiration of 8 days after the acceptance any complaint on behalf of the buyer is legally excluded. One as valid approved complaint implicates only the reimbursement of the effectively paid sum. Any claim, which reaches beyond it, will be excluded.

For objects, which underlie the regulations of the "Notifica dello Stato" after the paragraph 2,3 and 5 of the law 1/6/1089, the clients are obliged to the compliance of all hereof relevant official regulations.

International clients are called to attention, that the association cannot be made accountable for potential issued export restraints after the acceptance.

Payment conditions

After the acceptance of a bid, the vendor has to provide an adequate deposit of at least half of the price. The remaining amount is due at the collection of the object. The collection has to take place a) subsequent to the auction sale b) the following Monday. Charges and expenses for storage and insurance of the objects within this timeframe is at the expense of the organizer.

Vendors who cannot attend the auction sale personally and are impossible to collect the object in person, receive the invoice via post, payable after sight.

A later collection is generally only possible in agreement with the auction management. In such a case, the vendor will be charged with diverse fees and expenses for custody and insurance.

As from the point of collection, the auction house does not assume any liability for eventual transport damages or any other losses, due to negligence of the vendor.

The export of an object from Italy or the import from another country may require one or more export- import licenses.

The payment of the object has to be processed according to the terms of payment listed in the catalogue and an eventual not issued or with delay conferred export- or import license cannot lead to the dissolution or suspension of the purchase contract or respectively to a payment delay on behalf of the vendor.

Transport and collection

Surcharges

The vendor is in any case obliged to pay additionally to the highest bit, a surcharge in the amount of 22% inclusive the legal value added tax.
