Harris Estate Services, LLC - Terms & Conditions - Timed Auctions
THIS IS AN ONLINE ONLY AUCTION. NO LIVE OR TELEPHONE BIDDING. Acceptable forms of payment are Visa, MasterCard, Discover and American Express. You will be required to register your credit card with Invaluable/Auction Zip before bidding. We will contact you to get credit card information and charge your credit card within 24 hours after auction ends. Other payment terms (cash, check, money order, bank wire, etc.) must be approved by auctioneer at least 72 hours (3 days) before the auction event ends. No cash, checks, money orders, Paypal or other forms of payment will be accepted unless previous arrangements have been made before the auction event ends. If you are having your property shipped, you will pay the third party shipper directly.
INVOICING and PAYMENT COLLECTION: Complete payment is required immediately after you invoiced once the timed auction event has closed. We will contact you to get credit card information and charge your credit card within 24 hours after auction ends. If any property is not paid for within 72 hours (3 days) after bidding on the lot has closed, it is deemed noncollectable. The property will be resold.
Harris Estate Services, LLC - Terms & Conditions - Timed Auctions
1. GENERAL: ALL SALES ARE FINAL and all property is sold as shown and 'AS IS,' with all faults, imperfections, and errors of description. While Harris Estate Services, LLC, its employees and representatives, make every effort to accurately describe all property offered for sale, it is incumbent upon the bidder to satisfy themselves in all areas of authenticity, originality, condition and imperfections. Harris Estate Services, LLC, their employees and/or agents are not responsible for errors or omissions in description, genuineness or authenticity, and fault or defect in any property. No warranties or representations whatsoever are given by Harris Estate Services, LLC, its employees and/or agents, to any buyer in respect to any property. Bidders should also acknowledge that condition descriptions are often subjective and any property offered at auction may be subject to normal wear consistent with age that may not be specified in a condition description. It is the buyer's responsibility to know what shipping costs are before bidding. Harris Estate Services reserves the right to add or delete property throughout the auction.
2. PREVIEW: A preview period will be held for this auction event. Please see the section 'Specific Information for this Auction' You may contact us via Invaluable or e-mail to ask for a condition report at info@harrisestateservices.com
3. BUYER'S PREMIUM: A buyer's premium of 15% shall be added to each sold lot's winning bid hammer price to reach the total sales price.
4. SALES TAX: Purchases by bidders that live within the boundaries of South Carolina are subject to the collection of state and local sales taxes. Unless property is exempt by SC law, SC sales tax of 6% will be charged based on the total of the winning bid + buyer's premium and shown on the invoice for SC residents. For sales tax exemption the buyer must provide Harris Estate Services, LLC with a valid South Carolina Retail License Number and properly completed ST-8A Certificate of Exemption.

6. INVOICING and PAYMENT COLLECTION: Complete payment is required immediately after you receive an invoice once the timed auction has closed. We will charge your credit card within 24 hours after the timed auction has closed. Any property not paid for within 72 hours (3 days) after bidding on the property has closed shall be deemed noncollectable and unpaid property. In this event, the winning bidder forfeits the property.
7. Property PICK UP: Property paid for must be picked up at the date, time and place noted in the section entitled "Specific Information for this Auction". Property must be picked up at the assigned times. Harris Estate Services reserves the right to charge additional fees to meet a buyer on another pickup date/time. PLEASE NOTE WELL THAT BUYER IS RESPONSIBLE FOR MOVING AND LOADING ALL BUYER'S PROPERTY AT PICK UP. PLEASE ALLOW TIME TO LOAD LARGE ITEMS BEFORE PICK UP TIME IS OVER AND BRING HELP FOR LOADING HEAVY ITEMS. HARRIS ESTATE SERVICES IS NOT RESPONSIBLE FOR DAMAGE THAT MAY OCCUR TO BUYER'S PROPERTY AS A RESULT OF OUR ASSISTING YOU IN MOVING PROPERTY FROM THE SALE LOCATION. BUYER IS ALSO RESPONSIBLE FOR PACKING BREAKABLE ITEMS SUCH AS GLASS, ETC. SMALL ITEMS THAT ARE NOT PICKED UP WILL GO TO THE UPS STORE IN TAYLORS, SC WITHIN 24 HOURS AFTER THE SCHEDULED PICKUP TIME IS OVER. YOU MAY PICK UP YOUR PROPERTY AT THE UPS STORE AT YOUR CONVENIENCE. THE UPS STORE MAY CHARGE A SMALL FEE FOR THIS SERVICE.
8. SHIPPING: If you are not able to pick up your property and require your property to be shipped to you, we will be pleased to cooperate with a third party shipper at your request. We can recommend third party shippers that will provide services and bill you directly. PLEASE SEE THE SECTION 'Shipping' FOR DETAILS ABOUT SHIPPING AND RECOMMENDED THIRD-PARTY SHIPPERS. IF YOU ARE NOT ABLE TO PICK LARGE ITEMS UP, YOU WILL NEED TO SPECIFY A FREIGHT SHIPPER TO PICK UP YOUR PROPERTY FOR YOU. Please note that property identified as "LOCAL PICKUP ONLY" in the description will not be shipped.
9. REMOVAL of PROPERTY: All property must be removed from the sale premises by the purchaser at their expense no later than 3 business days following its sale and, if property is not removed, Harris Estate Services, LLC reserves the right to charge a minimum storage fee of $5 per auction lot per day or to deliver said property to a public warehouse for storage at the purchaser's expense. HARRIS ESTATE SERVICES RESERVES THE RIGHT TO CHARGE ADDITIONAL FEES TO MEET A BUYER ON ANOTHER PICKUP DATE/TIME. Harris Estate Services, LLC shall have no liability for any damage to property left on its premises or on the sale premises for more than 2 days following the end of auction. Unless arrangements have been made with Harris Estate Services, LLC, property not removed after thirty (30) calendar days from the end of auction date shall be deemed abandoned by winning bidder and shall be owned by Harris Estate Services, LLC.
10. WINNING BIDDER: The highest bidder shall be the buyer. The record of sale, as kept by the auctioneer, will be taken as absolute and final in all disputes between two or more bidders. The auctioneer will determine the winning bidder and the auctioneer's decision will be binding and final.
11. RESERVES: Reserve prices may be used, however, most lots are offered with no reserve price. A reserve price is a minimum price below which such a lot will not be sold. All lots are with reserve and auctioneer may withdraw any lot at anytime until the lot is sold.
12. BIDDING: All property is sold by online timed auction only. Harris Estate Services, LLC is not responsible for internet connection problems or website issues that cause missed bids. Timed auction bidders who desire to make certain their bid is accepted should use the maximum bid (automatic bid) feature of the timed auction system and leave their maximum bid at least 24 hours before the auction ends. The auction end time for a specific lot will be extended if that lot receives bids right before the auction lot closes. We reserve the right to decline bidding registration to any person.
13. AGREEMENT TO TERMS and CONDITIONS: Your bidding at this Auction indicates that you have read and accept these Terms of Sale.

PREVIEW of ITEMS: A preview of items will be held from 3-5 PM ET on Friday, August 30, 2019. The location for the preview is 16 Graves Drive, Greenville, SC 29609.
ITEM PICK UP: Paid items must be picked up on the day, time and place noted. Your items will be released as soon as payment is made. Items won in this timed auction may be picked up at the following date, time and place:

Please make your own arrangements for large items. We can provide dimensions and an estimate of weight to you. Freight shipments MUST be picked up within 3 days of auction close unless other arrangements have been made with auctioneer at least 72 hours (3 days) BEFORE auction closes.
All costs charged by shippers are sole responsibility of buyer. Buyer must provide payment information directly to shipper. PROPERTY DESCRIBED AS 'LOCAL PICKUP ONLY' WILL NOT BE SHIPPED.
