Terms and Conditions of the sale

auctionevente SAS is an Auction House registered under French law, article n° 2000-642 of 10th July 2000.
In addition to the hammer price, the buyer has to pay the following fees:
• 20% plus VAT at the current legal rate, i.e. 23.92% including VAT.
• Lots from outside the European Union (marked by an asterisk in the catalogue): The VAT must be added to imports (5.5% of the bidding price or 19.6% depending on the goods) and added to the fees and taxes quoted above.
Buyers are expected to pay for purchases immediately after the sale for the full sale price including fees and VAT, even if an export license is required. The person offering the highest bid is accepted by the auctioneer and will be the buyer. The striking of the hammer marks the acceptance of the highest bid and the conclusion of a contract of sale between the seller and the buyer. The buyer possesses the lot once he has paid auctionevente the full hammer price, the fees, VAT and commissions. The bid becomes the buyer's responsibility as soon as the bid has been accepted and on these terms, he accepts full financial responsibility and risks for the goods.
All sold items will be retained until all due amounts have been settled (i.e. the hammer price, buyer's premium and any applicable taxes).
Pre-auction viewing are open to the public, so no claims will be accepted once the bid has been accepted, especially in terms of accidents and any restoration work.
Dimensions and estimations are given on an indicative basis.
Payment:
Direct bank transfer in euros.
Debit or credit cards, Visa or Mastercard accompanied by a valid form of identification. The identity of the successful bidder will be the same as the identity of the person making the payment.
Cash:
Up to 3000€ for individuals with French fiscal residency, or if they are bidding on behalf of a company.
Up to 15,000€ for individuals who do not have French fiscal residency, or if they are not bidding on behalf of a company.
Certified bank cheques and guaranteed bank drafts drawn in euros and made payable to auction e vente, accompanied by a valid form of identification.
Checks drawn on a foreign bank will not be accepted.
Checks and bank wire transfers will be payable in euros to auctionevente SAS.
Export permits
Buyers should always check whether an export license is required before exporting, even for countries within the EU. It is the buyer's sole responsibility to obtain any relevant export permit.
Non payment
As per article 14 of French law n° 2000-642 of 10th July 2000, if the buyer fails to make payment in full cleared funds within the time required, the lot will be put into another auction if the seller wants on the basis of "award to the successful bidder". If the seller does not request this solution within a month of the auction date, the sale is legally settled with no damage or fees due by the failed buyer.
auctionevente reserves the right to demand the following from the failed buyer: interest at the legal going rate, reimbursements of any extra costs due to his failed bid, the payment of the hammer price or the difference between the first hammer price and the amount at which the item is eventually sold at resale, if this happens to be less, as well as the costs entailed by new bids.
auctionevente also reserves the right to proceed with compensation regarding the amount due by the failed buyer.
Right of Pre-emption
Please note that the French State is entitled to use the right of pre-emption on some objects (works of art, archives). This right might be exerted during an auction and must be confirmed in the 15 days following that same auction. If this right is confirmed within the given timescale, the French State has priority over the successful bidder.
Absentee Bids and Telephone Bids
Absentee bids must be submitted on the form found at the back of the catalogue.
Absentee bid forms must be sent to auctionevente at least two working days before the auction, as well as up-to-date bank references and a copy of the bidder's ID. For bids involving large sums of money, bank guarantees might be required. If written bids on a particular lot with identical amounts are received, it will be sold to the person whose written bid was received and accepted first.
Telephone bids are available for prospective bidders who cannot attend the auction. Telephone bidders are also required to complete and return a copy of the absentee bids form. Telephone bids cannot be accepted for lots estimated above 300€.
auctionevente and its representatives accepts no responsibility for the omission or fault of any absentee bid forms, as well as any absentee bids which are not executed.
At the Sale
The auctioneer has the right at his absolute and sole discretion to advance the bidding in such a manner as he may decide, to refuse any bid, to withdraw or divide any lot and, in the case of error or dispute, and whether during or after the sale, to determine the successful bidder, to continue the bidding, to cancel the sale or to reoffer and resell the item in dispute. In any dispute arises after the sale, the auctioneer's sales record is conclusive.

At the sale
