CONDITIONS OF BUSINESS

Boven's Veiling are acting as representatives for the seller and are not obliged to disclose the name of the seller to the intending buyer or buyer
The buyer is the person accepted as the highest bidder
The hammer price is the highest amount accepted by the auctioneer for a lot
The purchase price is the hammer price plus premium plus vat over the premium; is hammerprice plus 20% premium plus 21% vat over the 20%
The hammerprice is the amount for which the lot is sold.

THE BUYER
a Is the person accepted as the highest bidder by Bovens. the decision whether or not to accept a bid shall be made by
the auctioneer. The purchase agreement comes into being at the moment when Bovens accept a bid as the highest bid
b Each bidder is deemed to bid in his own name and for his own account
c Anyone wishing to bid at a sale must fill out and sign a registration form before the sale begins. A bidnumber will then be issued.
d By registering buyer declares to have convinced him/herself of the state and condition of the lots he/she bids on and has read and understood the conditions of business

PREMIUM AND INVOICE
A buyers premium shall be payable by the buyer to Boven's Veiling at a rate of 24,2% inclusive vat of the hammer price;
ie the total invoice is hammerprice+premium+vat over the premium..

PAYMENT
If no arrangements with Bovens have been made the buyer shall pay the purchase price to Bovens at the day of the sale, failing which he shall be in default
Boven's Auctioneers reserves the right to demand payment for the lot immediatly after a lot has been sold.
Payment is accepted either in cash, pin- or credit cards
Credit cards are accepted, 2,75% will be charged over the amount to be paid.

INTERNET BIDDING
By registering with www.invaluable.com it is possible to bid through the internet. Successfull buyers pay an extra 3% on the hammerprice for this service

LOTS AND COLLECTING
The lots in this sale are described at our best knowledge and will be sold in the state and condition they are at the moment of the sale and will not be subject to return.
The buyer shall be liable for the cost of removal, storage and insurance of any lot that has not been taken away by him before September 19th 2015.

RELEASE OF THE LOTS
The title to the lot shall not pass to the buyer until he has fully paid the purchase price. Buyer shall be liable for all risks and insurance immediately after the lot has been sold to him.

PREMIUM / OPGELD

A buyers premium shall be payable by the buyer to Boven's Veiling at a rate of 24,2% inclusive 21% vat of the hammer price.



PAYMENT

If no arrangements with Bovens have been made the buyer shall pay the purchase price to Bovens within twentyfour hours after the sale, failing which he shall be in default. When wiring the money notice that the full amount stated in the invoice has to be received in Bovens bankaccount. All costs, also for clearing banks, for wiring are for buyer.
Boven's reserves the right to ask for payment direct after the sale of a lot.

Credit cards are accepted, 2,75% will be charged over the amount to be paid.

Droit de Suite - the Artist's Resale Right
Droit de Suite is a royalty payable to a qualifying artist or the artist's heirs each time a work is re-sold during the artist's lifetime and for a period up to 70 years following the artist's death.
Following the introduction of the Artist's Resale Right Regulations 2006 on 14 February, an amount equal to the resale royalty will be collected from the buyer of a work of art covered by these Regulations. This will then be passed to the relevant collecting agency.
Royalties will be calculated using a sliding scale of percentages of the sale price, net of tax. For auction companies, the sale price is the hammer price (i.e., the price without the premium). However, the total amount of royalty on any one sale or lot shall not exceed €12,500. Resale royalties are not subject to VAT. Resale royalty does not apply when the hammer price is less than €3,000.

Percentage of Royalties: 4% up to €50,000; 3% €50,000-200,000
Maximum amount payable is €12,500, which will be the amount due -
Each time you bid on a lot covered by the DDS, you agree to pay an amount equal to the resale royalty, if you are the successful bidder. This amount will be added to your invoice.
