Buyers who successfully buy more than one painting may elect to have their works shipped together in order to save freight costs. We will provide a quote once total dimensions and weight are known.

Buyers may alternatively make their own arrangements for packing, handling, shipping and transit insurance for their Lot with prior agreement from Galerie Zadra. Shipping and handling are fully at the Buyer's risk.

Lots will be released to Buyers only once full payment has been received and the funds have cleared.

EXPORTS. Imports into Australia may be eligible for import tax exemptions.
Buyers with delivery addresses outside of the EU shall pay any customs duties, import taxes, fees or other costs incurred in connection with the import of the artwork to their country. It is the obligation of the buyer to inform him/herself about their country's import and export restrictions.

GALERIE ZADRA PTY LTD (AUSTRALIA) is running this online timed auction in association with ITONDO SARL (LUXEMBOURG) to sell Aboriginal artworks that are stored in Luxembourg.

AGENCY. Galerie Zadra and itondo SARL acts solely for and in the interests of the Sellers.

PROPERTY IS SOLD 'AS IS' and as Final Sale. Galerie Zadra warrants that the provenance of the work is as stated in the catalogue. While we have made every endeavour to accurately describe each Lot, Galerie Zadra accepts no responsibility for any errors in the description of the works.

REGISTRATION. All bidders must be registered and approved to bid via the Invaluable platform. Each approved bidder will be issued with a paddle number.

SUCCESSFUL BID. The maker of the highest bid for each Lot at the conclusion of the timed auction and accepted by Galerie Zadra shall be the Buyer, which shall be deemed to be a contract of sale. Galerie Zadra reserves the right to refuse any bid. Any dispute shall be settled at Galerie Zadra's absolute discretion.

AUSTRALIAN RESALE ROYALTY. If applicable, a Note shall be made against each Lot to which an Australian Resale Royalty applies. Should a Resale Royalty apply, an amount of 5% of the total sale price including Buyer's Premium and applicable GST shall be added to the Buyer's invoice. Galerie Zadra shall be responsible for collecting and paying the Royalties to the Copyright Agency Limited (CAL), and reporting all Resales to CAL, the Australian government authorised collection agency.

PURCHASE PRICE. The purchase price shall comprise the Hammer Price + Buyer's Premium. To this sum will be added the applicable sales tax for Buyers in Australia or the European Union; and Resale Royalty if applicable.

CURRENCY. The auction shall be listed and conducted in Australian Dollars (AUD), however invoicing will be in AUD or Euro (EUR) depending on their country of residence. See the condition below, "INVOICING & TAXES".

TITLE & RISK. Title shall not pass to the Buyer until the invoice has been paid in full and the funds have cleared. Risk - including loss and damage - in the Lot shall transfer to the Buyer either on the due date for payment, or on collection of the Lot, whichever is sooner.

Payment

The Buyer shall not receive Title in the work until the invoice has been paid in full and the funds have cleared. Payment by the Buyer shall be made within 7 days of receiving Galerie Zadra's invoice. Payment shall be in Australian Dollars by way of bank transfer, credit card, or PayPal. Galerie Zadra reserves the right to charge a credit card or PayPal processing fee, which will be at rate charged by the payment processing provider. Please contact us to confirm the current rates.

Buyer's Premium

The Buyer's Premium is 20%. It is calculated on the winning bid (hammer) price and is payable by the Buyer to Galerie Zadra. The Buyer's Premium will be added to the invoice.

Invoicing & Taxes

AUSTRALIA: For successful bids by bidders registered in Australia, applicable GST will be payable on the winning bid price + Buyer's Premium and added to the Buyer's invoice. The sale will be invoiced through Galerie Zadra Pty Ltd in AUSTRALIAN DOLLARS.

EUROPEAN UNION: Successful bids by bidders registered in an EU country - including the UK - will be invoiced in the equivalent amount in EURO (calculated at the exchange rate on the date of sale) through our Luxembourgish entity, and applicable VAT will be added to the Buyer's Premium.

REST OF WORLD: Successful bidders registered in any other country will be invoiced in the equivalent amount in EURO (calculated at the exchange rate on the date of sale) through our Luxembourgish entity. No sales tax will be applied to the invoice if the artwork is exported out of the EU, excepting entry to Australia.
