Auction Terms and Conditions

1. Lots put up for auction are either in possession of Polish Auction House Wojciech Sladowski (henceforth referred to as "Polish Auction House") or consigned to it as a commissioning agent. According to the statement of the consigners they are owners of consigned lots or have right to dispose of them, which are not subject to any legal and fiscal proceedings and are free from pledges, liens and claims by third parties.
2. The auction is conducted by the auctioneer, who determines the amount of bid increments, resolves any disputes or auctions the item once more.
3. Polish Auction House ensures auctioned items' features compliance with the catalogue specifications.
4. Paying 1000 PLN refundable deposit entitles to participate in the auction.
5. Individuals who want to remain anonymous or cannot bid in person can submit bid in absentia or bid telephonically. Submission of bids in absentia or telephonic bids must reach Polish Auction House 24 hours prior to the auction in order to agree on services: paying a deposit, establishing and maintaining connection and others. Some lots can have reserve prices, which remain confidential.
6. Once a lot has been knocked down, a contract of sale is concluded between Polish Auction House and the bidder whose bid has been accepted.
7. Successful bidder is obliged to buy the lot/lots in 10 days after the auction. In the case of payment default Polish Auction House can charge the buyer storage fee in the net amount of 100 PLN per each day of delay and withdraw from the sales agreement exposing the buyer to forfeiture of a deposit.
8. Ownership passes to the buyer only after full payment (including premium of 18% of the hammer price) has been received.
9. A premium of 18% of the hammer price will be added to the invoice. The charge is also levied on lots in post auction sale. Hammer price and premium are gross amount.
10. Polish Auction House is not liable for hidden physical and legal defects of purchased objects.
11. Any warranty claims will be considered on the basis of Polish law.
12. Registered museums which are interested in purchasing lots put up for auction should inform Polish Auction House about this at least 7 days prior to the auction.
13. Polish Auction House recalls following provisions of law:
a) The Act of 23 July 2003 on the protection and guardianship of monuments: export monuments abroad older than 55 years and whose value exceeds limits established in the act on the protection and guardianship of monuments shall require a single permit of relevant authorities.
(Bidders from outside Poland should ask no later than two days prior the auction if it is possible to export abroad the lot they would like to bid).
b) Article 20 of the Second Act of 21 November 1996 on Museums: registered museum shall be entitled to preemptive right to purchase artworks.
c) Act on money laundering and financing of terrorism of 16 November 2000 - Auction House is required to collect personal data from buyers of lots purchased at prices exceeding 15 thousand Euros. The customer will be requested for personal data needed to report transactions to the General Inspector of Financial Information. Customer's personal information remains confidential.
14. Polish Auction House is obliged to collect personal data of customers (Journal of Laws of the Republic of Poland, 4/12/2017 no. 2249).
15. Droit de suite is imposed on the sale of lots, marked in the catalogue with a sign "•" (placed at the starting price).
1) 5 % of the hammer price if the hammer price is less than or equal to 50 000 Euro
2) 3 % of the hammer price if the hammer price is greater than 50 000 Euro and is less than or equal to 200 000 Euro
3) 1 % of the hammer price if the hammer price is greater than 200 000 Euro and is less than or equal to 350 000 Euro
4) 0, 5 % of the hammer price if the hammer price is greater than 350 000 Euro and is less than or equal to 500 000 Euro
5) 0,25 % of the hammer price if the hammer price is greater than 500 000 Euro, but the maximum charge for the droit de suite is € 12,500.

Payment

Successful bidder is obliged to buy the lot/lots in 10 days after the auction.
