Participation in the auctions implies the unconditional acceptance of the following terms. Please read them carefully before the sale. Auctions are conducted under the direction of Leroy & Partners, court bailiffs in Brussels. Any visitor is responsible up to the amount of the highest estimate of any damage caused to the property on display. Except as otherwise stated, 51 Gallery only acts as agent for the seller. The contract for the sale is therefore made between the seller and the buyer, who will be the highest bidder. In addition to the hammer price, any buyer agrees to pay a 20% premium - 23% premium for any live bidder - together with any applicable VAT. The artist's resale right, if applicable, will be added and charged on the hammer price. For any lot marked with an asterisk (*), an additional tax, if applicable, will be added and charged on the full amount. Please contact 51 Gallery for further information relative to these matters. Starting prices, estimates, bids and invoices are in Euros. Any bidder is responsible for errors in bidding. 51 Gallery accepts no liability for failure, errors or omissions in connection with written, phone or internet bids. Any bidder personally guarantees payment for his successful bids - including commission bids from other parties. Invoices are due and payable immediately upon receipt. Payment may be made by cash, wire transfer or credit cards (with a 2% surcharge). Personal or company checks will not be accepted. 51 Gallery may reduce or compromise any charge or fee at his absolute and sole discretion. Interest of 2% per month could be payable on invoices not settled within 30 days after the sale. Title does not pass until full payment. Any prospective buyer is strongly advised to examine personally any lot in which he is interested before the auction, during public exhibitions or by appointment, and particularly for any lot of significant value, to seek advice from experts. It must be clearly understood that, due to the nature of the auction process, 51 Gallery is unable to carry out exhaustive research of the kind undertaken by historians and scholars. Therefore, any statement, whether oral or written - including, but not limited to, authorship, date, technique, size, colors, provenance, value - is only the expression of 51 Gallery's opinion or belief. Such statements do not constitute a representation, warranty or assumption of liability of any kind. References to damages, defects or restorations does not imply the absence of any others; the absence of such a reference does not imply that any lot is free from damages, defects or restorations. Lots are sold in the condition in which they were offered for sale. No complaint will thus be accepted after the sale. 51 Gallery has the right, at his absolute and sole discretion, to request the departure of any person disrupting any auction, to withdraw, divide or join any lot, to refuse or advance any bid, to bid on behalf of the seller when a reserve price has been set - if the reserve price is not met, any lot will be passed by rapping the gavel. In the case of errors or disputes, during or after any auction, 51 Gallery has the right, on the bailiff's advice, to determine the successful bidder, continue the bidding, cancel the sale or reopen the lot. Any bidder waives any right to require disclosure of the identity of any seller or owner. Any bidder hereby irrevocably waives any claim for any direct, indirect, special, incidental, consequential, punitive or exemplary damage arising out of auctions. Any bidder waives any contrary provision of articles 14 or 15 of the French Civil Code as well as at any similar provision. The courts of Brussels will thus have absolute and sole jurisdiction in the event of litigation and the French version of these auction terms will be definitive. Should any provision of these terms be held void, invalid or unenforceable, the remaining provisions will continue in full force and effect without being impaired or invalidated.
