Description

HAROLD BURTON (1888- 1964) Associate Justice of the Supreme Court. A.N.S. signed "H.H.B." as Associate Justice, [n.p.], Feb. 5, 1947 in pencil at the top and bottom of a typed memo headed "Power of Court to Remit Contempt Fine ". Burton has noted: "Memo to the Chief Justice (Preliminary report from my law clerk...Suggest therefore that a court could reserve the right to reexamine the fine at the conclusion of the hearing on the merits. HHB". The memo cites several cases in which courts have remitted contempt fines, though the case law appears weak, and concludes: "None of these cases are strong, but they give a hint as to proper practice".
