Auction, sale, payment and delivery conditions for auctions u. Freehand sale. The following terms and conditions of Auction House Bossard apply to all auctions, the sale of auction items after an auction (post-sale), the free sale of goods (free sale), exhibitions and the brokering of goods.
Auction House Bossard - possibly represented by an employee or agent - will auction in its own name, but voluntarily and on behalf of and for the account of the client, who remain unnamed. Exempted is own goods, which are specially marked. With the submission of a bid or a written purchase order or the personal, written or telephone participation in an auction, the following auction conditions, the same applies to the free sale of auction goods before or after an auction and also for the delivery and processing of objects for are considered an auction, expressly and unreservedly recognized.

1. The auction is voluntary. Bidders and buyers are not entitled to announce the consignor.

2. The bidder acquires in his own name, for his own account and at his own risk, if he does not provide the name and address of a client in writing prior to the auction. The auctioneer assumes the collection of the auction proceeds, he is commissioned by the consignor. After issuing a bidder number, the bidder is liable for the misuse of his bidder number. Personally present bidders who are unknown to the auctioneer may be asked to identify themselves. The auctioneer is entitled to refuse written or verbal bids without stating reasons. The tenderer must provide sufficient security or references before the auction. Attention: Written bids are irrevocable!

3. The auctioned goods can be viewed in the auctioneer's business premises prior to the auction at the time specified by the press and checked at the risk of the interested party. The items are usually needed and are slammed in the state in which they are at the surcharge. Corresponding descriptions of the condition are only indicated if there are obvious damages or restorations or if significant irregularities due to manufacture are noted. Normal signs of age and wear remain unmentioned. The absence of this notice does not imply that the item is in perfect condition or is free from defects or defects. The bidder was convinced of the condition of the objects on display before the auction. The catalog descriptions made to the best of our knowledge and belief are not guaranteed properties in the sense of §§ 434 ff. BGB, but only descriptions of the current condition. For catalog descriptions as well as related written and oral explanations are not liable, they contain no guarantees in the legal sense. This applies in particular to any information on origin, condition, function, age, authenticity, size, weight, signatures, trademarks, material, origin and attribution, which are to be regarded in principle as expression of opinion and not as factual statement. The image section in the catalog is generally for additional information, errors excepted. In the case of discrepancies between the image and the text, the text is binding. For spelling mistakes no liability is assumed. All information in the catalog are generally without guarantee, oral information as well. The auctioneer accepts no liability for any open or hidden defects of any kind. Once the contract has been awarded, complaints of any kind can no longer be considered. For bundles, books, multi-volume magazines or series, no guarantee is given for their completeness. You are excluded from any possibility of a complaint. Notifications of defects must be submitted within three days of receipt of the goods, but no later than 4 weeks after the auction. Complaints after this period or late receipt of payment are excluded. A complaint has no suspensive effect on the due date of the payment of the goods. All claims for damages of a buyer against the auction house due to material defects or other legal reasons - including the reimbursement of futile expenses or lost profits - are hereby excluded.

4. The consignor has also taken over the guarantee and liability for his objects against the buyer with the auction contract. Qualified complaints can therefore only be directed to the owner of the goods, not to the auctioneer. Damages by the auction house Bossard is thereby excluded. The Auctioneer therefore assigns to the purchaser all possible claims against the purchaser
