In-folio, veau brun, double encadrement de deux filets avec fleurons aux angles, important fer azuré au centre des plats avec armoiries sur médaillon réservé au milieu, dos orné de fleurons, tranches dorées (Reliure de l'époque).
Superbe impression de cet ouvrage fondateur et célèbre, considéré comme l'un des premiers monuments de la langue française, à l'origine de la théologie réformée et de la prose française d'idées, dont la première édition latine vit le jour à Bâle en 1536, traduite ensuite en français par Calvin lui-même et publiée à Genève en 1541. Les versions latine et française définitives, après plusieurs remaniements, sont respectivement de 1559 et 1560. Notre édition, admirablement imprimée par François Perrin de Genève, deux ans après la mort du grand réformateur, contient les tables revues et augmentées par l'exégète et martyr Augustin Marlorat (1506-1562). John Calvin né Jean Cauvin (10 July 1509 - 27 May 1564) was an influential French theologian and pastor during the Protestant Reformation. He was a principal figure in the development of the system of Christian theology later called Calvinism. Originally trained as a humanist lawyer, he suddenly broke from the Roman Catholic Church in the 1520s. After religious tensions provoked a violent uprising against Protestants in France, Calvin fled to Basel, Switzerland, where in 1536 he published the first edition of his seminal work Institutes of the Christian Religion.Calvin was invited by William Farel to help reform the church in Geneva. The city council resisted the implementation of Calvin and Farel's ideas, and both men were expelled. At the invitation of Martin Bucer, Calvin proceeded to Strasbourg, where he became the minister of a church of French refugees. He continued to support the reform movement in Geneva, and was eventually invited back to lead its church. Following his return, he introduced new forms of church government and liturgy, despite the opposition of several powerful families in the city who tried to curb his authority. During this period, Michael Servetus, a Spaniard known for his heretical views, arrived in Geneva. He was denounced by Calvin and executed by the city council. Following an influx of supportive refugees and new elections to the city council, Calvin's opponents were forced out. Calvin spent his final years promoting the Reformation both in Geneva and throughout Europe.Calvin was a tireless polemic and apologetic writer who generated much controversy. He also exchanged cordial and supportive letters with many reformers including Philipp Melanchthon and Heinrich Bullinger. In addition to the Institutes, he wrote commentaries on most books of the Bible as well as theological treatises and confessional documents, and he regularly gave sermons throughout the week in Geneva. Calvin was influenced by the Augustinian tradition, which led him to expound the doctrine of predestination and the absolute sovereignty of God in salvation.Calvin's writing and preaching provided the seeds for the branch of theology that bears his name. The Presbyterian and other Reformed churches, which look to Calvin as a chief expositor of their beliefs, have spread throughout the world. Calvin's thought exerted considerable influence over major religious figures and entire religious movements, such as Puritanism, and his ideas have been cited as contributing to the rise of capitalism, individualism, and representative democracy in the West.

CONDITIONS OF PURCHASE
ALDE is an auction sales company, regulated by the law dated July 10, 2000, with a capital of 10 000 €, registered in Paris. In such capacity ALDE acts as the agent of the seller who contracts with the buyer. The relationships between ALDE and the buyer are subject to the present general conditions of purchase which can be modified by saleroom notices or oral indications given at the time of the sale, which will be recorded in the official sale record.

1 - Goods for auction
a) The prospective buyers are invited to examine any goods in which they may be interested, before the auction takes place, and notably during the exhibitions. ALDE is at disposal of the prospective buyers to provide them with reports about the conditions of lots.
b) The statements by made ALDE about any restoration, mishap or harm arisen concerning the lot are only made to facilitate the inspection thereof by the prospective buyer and remain subject to his own or to his expert's appreciation. The absence of statements ALDE by relating to a restoration, mishap or harm, whether made in the catalogue, condition reports, on labels or orally, does not imply that the item is exempt from any current, past or repaired defect. Inversely, the indication of any defect whatsoever does not imply the absence of any other defects.

2 - The sale
a) In order to assure the proper organisation of the sales, prospective buyers are invited to make themselves known to ALDE before the sale, so as to have their personal identity data recorded.
b) Any person who is a bidder undertakes to pay personally and immediately the hammer price increased by the premium and any which could be due. Any bidder is deemed acting on his own behalf except when prior notification, accepted by ALDE, is given that he acts as an agent on behalf of a third party.
c) ALDE may graciously accept to receive some bids by telephone from a prospective buyer who has expressed such a request before the sale, as long as the estimate of the lot is higher than 300 €.
ALDE will bear no responsability, notably if the telephone contact is not made, or if it is made too late, or in case of mistakes or omissions relating to the reception of the telephone. For variety of purposes, ALDE reserves its right to record all the telephone communications during the auction. Such records shall be kept until the complete payment of the auction price, except claims.
d) ALDE may accept to execute orders to bid which will have been submitted before the sale and by ALDE which have been deemed acceptable. Should ALDE receive several instructions to bid for the same amounts, it is the instruction to bid first received, which will be given preference. ALDE will bear no liability/responsibility in case of mistakes or omission of performance of the written order.
e) In the event where a reserve price has been stipulated by the seller, ALDE reserves the right to bid on behalf of the seller until the reserve price is reached. The seller will not be admitted to bid himself directly or through an agent.
The reserve price may not be higher than the low estimate of the lot printed in the catalogue.
f) ALDE will conduct auction sales at their discretion, in accordance with established practices.
ALDE reserves the right to refuse any bid, to organise the bidding in such manner as may be the most appropriate, to move some lots in the course of the sale, to withdraw any lot in the course of the sale, to combine or to divide some lots in the course of the sale.
In case of challenge or dispute, ALDE reserves the right to designate the successful bidder, to continue the bidding or to cancel it, or to put the lot back up for bidding.
g) Subject to the decision of the person conducting the bidding for ALDE, the successful bidder will be the bidder would will have made the highest bid provided the final bid is equal to or higher than the reserve price if such a reserve price has been stipulated. The pronouncing of the word "adjugé" or any equivalent will amount to the conclusion of the purchase contract between the seller and the last bidder taken in consideration. No lot will be delivered to the buyer until full payment has been made.
In case of payment by an ordinary draft/check, payment will be deemed made only when the check will have been cashed.

3 - The incidents of the sale
a) In case two bidders have bidden vocally, by mean of gesture or by telephone for the same amount and both claim title to the lot, after the bidding the lot, will immediately be offered again for sale at the previous last bid, and all those attending will be entitled to bid again.
b) So as to facilitate the presentation of the items during the sales, ALDE will be able to use video technology. Should any error occur in operation of such, which may lead to show an item during the bidding which is not the one on which the bids have been made, ALDE shall bear no responsability whatsoever, and will have sole discretion to decide whether or not the bidding will take place again.
c) So as to facilitate the price calculation for prospective buyers, a currency converter may be operated by ALDE as guidance. Nevertheless, the bidding cannot be made in foreign currency and ALDE will not be liable for errors of conversion.

4 - Pre-emption of the French state
The French state in entitled to use a right of pre-emption on works of art, pursuant to the laws dated December 31, 1921 and July 10, 2000. The use of this right comes immediately after the hammer stroke, the representative of the French state expressing then the intention of the State to substitute for the last bidder, provided he confirms the pre-emption decision within fifteen days.

5 - The performance of the sale
a) In addition of the lot's hammer price, the buyer must pay the following premium and fees/taxes:

1) Lots from the EEC: 20%

2) Lots from outside the EEC : In addition to the commissions and taxes indicated above, an additional import VAT will be charged (5,5% of the hammer price).
The taxes (VAT on commissions and VAT on importation) can be retroceded to the purchaser on presentation of written proof of exportation outside the EEC. An EEC purchaser who will submit his intra-Community VAT number will be exempted from paying the VAT on commissions.
The payment of the lot will be made cash, for the whole of the price, costs and taxes, even when an export licence is required. The purchaser will be authorized to pay by the following means :
in cash: up to 3 000 euros, costs and taxes included, for French citizen, up to 7 600 euros, costs and taxes included, for foreign citizen on presentation of their documents.
By cheque or bank transfer.
By credit card : VISA.
b) ALDE will be authorized to reproduce in the official sale record and on the bid summary the information that the buyer will have provided before the sale. The buyer will be responsible for any false information given. Should the buyer have neglected to give his personal information before the sale, he will have to give the necessary information as soon as the sale of the lot has taken place.
Any person having been recorded by ALDE has a right of access and of rectification to the nominative data provided to ALDE pursuant to the provisions of the Law dated July 6, 1978.
c) The lot must to be insured by the buyer immediately after the purchase. The buyer will have no recourse against ALDE in the event where, due to a theft, a loss or a deterioration of his lot after the purchase, the compensation he will receive from the insurer of ALDE would be unsufficient.
d) The lot will be delivered to the buyer only after the entire payment of the price, costs and taxes.
In the meantime ALDE may invoice to the buyer the costs of storage of the lot, and if applicable the costs of handling and transport.
Should the buyer fail to pay the amount due, and after notice to pay has been given by ALDE to the buyer without success, at the seller's request, the lot is re-offered for sale, under the French procedure known as "procédure de folle enchère". If the seller does not make this request within a month from the date of the sale, the sale will be automatically cancelled, without prejudice to any damages owed by the defaulting buyer.
In addition, ALDE reserves the right to claim against the defaulting buyer, at their option:
interest at the legal rate increased by five points,
the reimbursement of additional costs generated by the buyer's default,
the payment of the difference between the initial hammer price and the price of sale after "procédure de folle enchère" if it is inferior as well as the costs generated by the new auction.
ALDE also reserves the right to set off any amount ALDE may owe the defaulting buyer with the amounts to be paid by the defaulting buyer. ALDE reserves the right to exclude from any future auction, any bidder who has been a defaulting buyer or who has not fulfilled these general conditions of purchase.
e) For items purchased which are not collected within seven days from after the sale (Saturdays, Sundays and public holidays included), ALDE will be authorized to move them into a storage place at the defaulting buyer's expense, and to release them to same after payment of corresponding costs, in addition to the price, costs and taxes.

Conditions de vente
ALDE est une sarl de ventes volontaires de meubles aux enchères publiques régie par la Loi du 10 juillet 2000 au capital de 10000 €, enregistrée au RCS de Paris. En cette qualité, ALDE agit comme mandataire du vendeur qui contracte avec l'acquéreur. Les rapports entre ALDE et l'acquéreur sont soumis aux présentes conditions générales de vente qui pourront être modifiées par des avis écrits ou oraux qui seront mentionnés au procès-verbal de vente.

1 - Le bien mis en vente
a) Les acquéreurs potentiels sont invités à examiner attentivement les biens pouvant les intéresser avant la vente aux enchères, et notamment pendant les expositions. ALDE se tient à la disposition des acquéreurs potentiels pour leur fournir des rapports sur l'état des objets présentés.
b) Les indications données par ALDE sur l'existence d'une restauration, d'un accident ou d'un incident affectant le lot, sont exprimées pour faciliter son inspection par l'acquéreur potentiel et restent soumises à son appréciation personnelle. L'absence d'indication d'une restauration d'un accident ou d'un incident dans le catalogue, les rapports, les étiquettes ou verbalement, n'implique nullement qu'un bien soit exempt de tout défaut présent, passé ou réparé. Inversement la mention de quelque défaut n'implique pas l'absence de tous autres défauts.

2 - La vente
a) En vue d'une bonne organisation des ventes, les acquéreurs potentiels sont invités à se faire connaître avant la vente auprès de la société ALDE, afin de permettre l'enregistrement de leurs identités et références bancaires.
b) Toute personne qui se porte enchérisseur s'engage à régler personnellement et immédiatement le prix d'adjudication augmenté des frais à la charge de l'acquéreur et de tous impôts ou taxes qui pourraient être exigibles. Tout enchérisseur est censé agir pour son propre compte sauf dénonciation préalable de sa qualité de mandataire pour le compte d'un tiers, acceptée par ALDE.
c) ALDE pourra accepter gracieusement de recevoir des enchères par téléphone d'un acquéreur potentiel qui se sera manifesté avant la vente, sous réserve que l'estimation de l'objet soit supérieure à 300 €. ALDE ne pourra engager sa responsabilité si la liaison téléphonique n'est pas établie, est établie tardivement, ou en cas d'erreur ou d'omissions relatives à la réception des enchères par téléphone. ALDE se réserve le droit d'enregistrer les communications téléphoniques durant la vente. Les enregistrements seront conservés jusqu'au règlement du prix, sauf contestation.
d) ALDE pourra accepter gracieusement d'exécuter des ordres d'achats qui lui auront été transmis avant la vente et que la société ALDE aura acceptés.En cas d'ordres d'achat d'un montant identique, l'ordre le plus ancien sera préféré. ALDE ne pourra engager sa responsabilité en cas d'erreur ou d'omission d'exécution de l'ordre écrit.
e) Dans l'hypothèse où un prix de réserve aurait été convenu avec le vendeur, ALDE se réserve de porter des enchères pour le compte du vendeur jusqu'à ce que le prix de réserve soit atteint. En revanche, le vendeur n'est pas admis à porter lui-même des enchères directement ou par mandataire.
Le prix de réserve ne peut dépasser l'estimation basse figurant dans le catalogue.
f) ALDE dirigera la vente de façon discrétionnaire tout en respectant les usages établis. ALDE se réserve le droit de refuser toute enchère, d'organiser les enchères de la façon la plus appropriée, de déplacer certains lots lors de la vente, de retirer tout lot de la vente, de réunir ou de séparer des lots. En cas de contestation, ALDE se réserve le droit de d'adjuger, de poursuivre la vente ou de l'annuler, ou encore de remettre le lot en vente.
g) L'adjudicataire sera la personne qui aura porté l'enchère la plus élevée pourvu qu'elle soit égale ou supérieure au prix de réserve, éventuellement stipulé. Le prononcé du mot «adjugé» entraîne la formation du contrat de vente entre le vendeur et le dernier enchérisseur retenu. L'adjudicataire ne pourra obtenir la livraison du lot qu'après règlement de l'intégralité du prix. En cas de remise d'un chèque ordinaire, seul l'encaissement du chèque sera considéré comme règlement.

3 - Les incidents de la vente
a) Dans l'hypothèse où deux personnes auront porté des enchères identiques par la voix, le geste, ou par téléphone et réclament en même temps le bénéfice de l'adjudication après l'adjudication, le bien sera immédiatement remis en vente au prix proposé par les derniers enchérisseurs, et tout le public présent pourra à nouveau porter des enchères.
b) Pour faciliter la présentation des biens lors de ventes, ALDE pourra utiliser des moyens vidéos. En cas d'erreur de manipulation pouvant conduire pendant la vente à présenter un bien différent de celui sur lequel les enchères sont portées, ALDE ne pourra engager sa responsabilité, et sera seul juge de la nécessité de recommencer les enchères.
c) Pour faciliter les calculs des acquéreurs potentiels, ALDE pourra être conduit à utiliser à titre indicatif un système de conversion de devises. Néanmoins, les enchères ne pourront être portées en devises, et les erreurs de conversion ne pourront engager la responsabilité d'ALDE.

4 - Préemption de l'État
L'État dispose d'un droit de préemption des œuvres vendues conformément aux Lois des 31 décembre 1921 et 10 juillet 2000.
L'exercice de ce droit intervient immédiatement après l'adjudication, le représentant de l'Etat manifestant alors la volonté de ce dernier de se substituer au dernier enchérisseur, et devra confirmer la préemption dans les 15 jours.

5 - L'exécution de la vente
a) En sus du prix de l'adjudication, l'adjudicataire devra acquitter par lot et par tranche dégressive les commissions et taxes suivantes :
1) Lots en provenance de l'Union : 20 % TTC.
2) Lots hors Union : aux commissions et taxes indiquées ci-dessus, il convient d'ajouter la TVA à l'importation, (5,5 % du prix d'adjudication).
3) Les taxes (TVA sur commissions et TVA à l'importation) pourront être rétrocédées à l'adjudicataire sur présentation des justificatifs d'exportation hors Union. Un adjudicataire membre de l'Union justifiant d'un numéro de TVA intracommunautaire sera dispensé d'acquitter la TVA sur les commissions. Le paiement du lot aura lieu au comptant, pour l'intégralité du prix, des frais et taxes, même en cas de nécessité d'obtention d'une licence d'exportation. L'adjudicataire pourra s'acquitter par les moyens suivants :
en espèces : jusqu'à 3 000 € frais et taxes compris pour les ressortissants français, jusqu'à 7 600 € frais et taxes compris pour les ressortissants étrangers sur présentation de leurs papiers d'identité.
par chèque ou virement bancaire.
par carte VISA.
b) ALDE sera autorisé à reproduire sur le procès-verbal de vente et sur le bordereau d'adjudication les renseignements qu'aura fournis l'adjudicataire avant la vente. Toute fausse indication engagera la responsabilité de l'adjudicataire. Dans l'hypothèse où l'adjudicataire ne se sera pas fait enregistrer avant la vente, il devra communiquer les renseignements nécessaires dès l'adjudication. Toute personne s'étant fait enregistrer auprès d'ALDE dispose d'un droit d'accès et de rectification aux données nominatives fournies à ALDE dans les conditions de la Loi du 6 juillet 1978.
c) Le transfert de propriété dès l'adjudication, entraîne l'entière responsabilité de l'acquéreur quant à d'éventuels dommages qui pourraient survenir. La responsabilité de la société ALDE ne pourra être engagée, dans l'hypothèse où par suite du vol, de la perte ou de la dégradation de son lot après l'adjudication, l'indemnisation qu'il recevra de l'assureur d'ALDE s'avèrerait insuffisante.
d) Le lot ne sera délivré à l'acquéreur qu'après paiement intégral du prix, des frais et des taxes. Dans l'intervalle, ALDE pourra facturer à l'acquéreur des frais de magasinage, et éventuellement des frais de manutention et de transport. À défaut de paiement par l'adjudicataire, après mise en demeure restée infructueuse, le bien est remis en vente à la demande du vendeur sur folle enchère de l'adjudicataire défaillant ; si le vendeur ne formule pas cette demande dans un délai d'un mois à compter de l'adjudication, la vente est résolue de plein droit, sans préjudice de dommages intérêts dus par l'adjudicataire défaillant. En outre, ALDE se réserve de réclamer à l'adjudicataire défaillant, à son choix :
des intérêts au taux légal majoré de cinq points,
le remboursement des coûts supplémentaires engendrés par sa défaillance,
le paiement de la différence entre le prix d'adjudication initial et le prix d'adjudication sur folle enchère s'il est inférieur, ainsi que les frais de remise en vente. ALDE se réserve d'exclure de ses ventes futures, tout adjudicataire qui aura été défaillant ou qui n'aura pas respecté les présentes conditions générales de vente.
e) Les achats qui n'auront pas été retirés dans les sept jours de la vente (samedi, dimanche et jours fériés compris), pourront être transportés dans un lieu de conservation aux frais de l'adjudicataire défaillant qui devra régler le coût correspondant pour pouvoir retirer son lot, en sus du prix, des frais et des taxes.

ALDE è una SARL di vendite volontarie di mobili d'aste pubbliche, sottoposta alla legge del 10 Luglio 2000, con capitale sociale di Euro 10.000,00 ed iscrizione al Registro delle imprese (RCS) di Parigi. Nello svolgimento della sua attività di vendita, ALDE agisce in qualità di mandataria del Venditore che contratta con l'Aggiudicatario. I rapporti tra ALDE e l'Acquirente sono sottoposti alle presenti condizioni generali di vendita, e potranno essere modificati per avviso scritto o orale che verrà annotato nel verbale della vendita.

1- L'oggetto offerto in vendita
a) Chiunque sia interessato, potrà prendere piena, completa e attenta visione degli oggetti prima della vendita e durante l'esposizione. ALDE è a Vostra disposizione per informarvi sullo stato degli oggetti.
b) Le indicazioni a proposito di un restauro o imperfezione dell'oggetto sono date da ALDE per aiutare l'esame del potenziale acquirente, e rimarranno disponibili per una valutazione personale.
La mancanza di informazioni sul restauro o imperfezione, sia nel catalogo che nei rapporti, nelle etichette o per via orale non significa che l'oggetto non ne abbia o non ne abbia avuto, sia nel presente che nel passato, o che non sia stato riparato.
All'inverso, l'indicazione di un'imperfezione non significa l'assenza di altri danni.

2- La vendita
a) Per una buona organizzazione della vendita, coloro che desiderano partecipare ad un'asta, dovranno preventivamente compilare e sottoscrivere una scheda di partecipazione, indicando i dati personali e le referenze bancarie.
b) L'Acquirente s'impegna a corrispondere ad ALDE il prezzo di aggiudicazione più i diritti d'asta, e tutte le imposte o tasse che potrebbero essere richieste, immediatamente dopo la conclusione dell'asta.
L'Acquirente agisce a nome proprio. Se agisce come mandatario per conto di terzi, lo dovrà comunicare ad ALDE che darà la sua accettazione.
c) Sarà possibile partecipare all'incanto per telefono esclusivamente per lotti superiori alle 300 Euro. L'Acquirente dovrà comunicarlo prima della vendita.
ALDE non sarà responsabile per i problemi di collegamento via telefono, né per la comunicazione stabilita con ritardo, né in caso di errori o omissioni relative alle aste offerte per telefono.
ALDE si riserva il diritto di registrare le comunicazioni telefoniche durante la vendita. Le registrazioni verranno conservate finché l'aggiudicatario avrà pagato il lotto, anche in caso di contestazione.
d) ALDE si riserva la facoltà di accettare gratuitamente mandati per l'acquisto di determinati lotti da parte di clienti, prima della vendita. In caso di parità, verrà preferito il mandato pervenuto per primo.
ALDE non sarà responsabile in caso di errori o di omissioni dell'esecuzione del mandato.
e) Nel caso venisse indicato un limite di riserva dal Venditore, ALDE potrà andare avanti nell'incanto finché questo limite sarà raggiunto. Invece, il Venditore non potrà partecipare all'incanto né direttamente né per mezzo di un mandatario. I limiti di riserva imposti non potranno oltrepassare la stima minima indicata nel catalogo.
f) La vendita si svolgerà a discrezione di ALDE, nel rispetto della prassi stabilita. ALDE, a sua discrezione, potrà rifiutare ogni incanto, variare l'ordine di vendita di alcuni lotti, ritirarne, abbinare e/o separare lotti.
Qualora durante lo svolgimento di un'asta sorga controversia, il banditore potrà, a sua discrezione, procedere all'aggiudicazione o annullarla o rimettere il lotto in vendita all'asta e procedere ad una nuova aggiudicazione.
g) Gli oggetti offerti all'asta saranno aggiudicati al miglior offerente, che dovrà fare un'offerta uguale o superiore al limite di riserva, che verrà eventualmente indicato. Il pronunciare la parola "aggiudicato" determina il contratto di vendita tra il Venditore e l'acquirente che avrà fatto l'ultima offerta. L'Aggiudicatario potrà ritirare i lotti soltanto dopo avere effettuato il pagamento per intero. In caso di pagamento per mezzo di assegno, quest'ultimo verrà preso in conto soltanto dopo che la somma sarà stata incassata in banca.

3- Incidenti durante la vendita
a) Qualora durante lo svolgimento di un'asta sorga una controversia tra chi abbia diritto all'aggiudicazione, avendo due persone offerto un prezzo simile, sia a voce che a gesto o al telefono, il banditore ha la facoltà di riaprire l'incanto sulla base dell'ultima offerta che ha determinato l'insorgere della contestazione. Tutto il pubblico potrà di nuovo partecipare all'incanto.
b) Per facilitare la presentazione degli oggetti durante l'asta, ALDE potrà usare la videocamera.
Se avvenissero problemi di manipolazione, presentando un oggetto diverso da quello sul quale verranno lanciate le offerte, ALDE non ne potrà essere responsabile, e rimarrà a discrezione del banditore, se ricominciare l'asta.
c) Per facilitare i calcoli dei potenziali acquirenti, ALDE potrà eventualmente usare, a titolo indicativo, un sistema di conversione di divise. Tuttavia l'incanto non si svolgerà in divisa, e ALDE non sarà responsabile per gli errori di conversione.
4- Diritto di prelazione dello Stato
Lo Stato ha un diritto di prelazione delle opere vendute, secondo le Leggi del 31 Dicembre 1921 e del 10 Luglio 2000. L'esercizio di questo diritto deve intervenire immediatamente dopo l'aggiudicazione. Il rappresentante dello Stato, facendo conoscere la sua volontà di sostituirsi all'ultimo offerente, dovrà confermare la prelazione nei 15 giorni seguenti.

5- Svolgimento della vendita
a) La proprietà dei lotti aggiudicati passa all'Aggiudicatario solo previo pagamento integrale del prezzo di aggiudicazione e delle commissioni per i diritti d'asta e tasse seguenti:

1) Lotti in provenienza dell'Unione Europea: 20% (compresa IVA).
2) Lotti provenienti da fuori dell'Unione Europea: alle commissioni e tasse indicate sopra, verrà aggiunta l'IVA all'importazione (5,5% del prezzo di aggiudicazione).
3) Le tasse (IVA sulle commissioni e IVA all'importazione) potranno essere rimborsate all'Aggiudicatario nel caso presenti giustificativi di esportazione fuori dell'Unione Europea. Un Aggiudicatario dell'Unione Europea, avendo un numero di IVA comunitaria non pagherà l'IVA sulle commissioni. Il pagamento del lotto verrà effettuato in contanti, per l'intero prezzo di aggiudicazione, spese e tasse comprese, anche nel caso dovesse ottenere un permesso di esportazione. L'Aggiudicatario potrà fare il pagamento seguendo le seguenti modalità di pagamento:
in contanti fino a Euro 3.000,00, spese e tasse incluse, per i cittadini francesi. Fino a Euro 7.600,00, spese e tasse incluse, per i cittadini stranieri, su presentazione di un documento.
mediante assegno bancario o bonifico bancario,
mediante carta di credito VISA.
b) ALDE potrà indicare sul verbale di vendita e sulla fattura di aggiudicazione i dati trasmessi dall'Aggiudicatario prima della vendita. Ogni informazione falsa rimarrà sotto la responsabilità dell'Aggiudicatario. Nel caso in cui l'Aggiudicatario non si sia fatto registrare prima della vendita, dovrà lasciare le informazioni richieste immediatamente dopo l'aggiudicazione. Chiunque si fosse fatto registrare e volesse modificare i propri dati, potrà farlo seguendo le condizioni della Legge del 6 Luglio 1978.
c) Il trasferimento di proprietà dopo l'aggiudicazione determina l'intera responsabilità dell'Aggiudicatario per quanto riguarda eventuali danni che potrebbero avvenire. ALDE non sarà responsabile, se il lotto fosse rubato, perso o danneggiato dopo l'aggiudicazione. Il compenso ricevuto dall'assicurazione di ALDE potrebbe non corrispondere all'intero valore.
d) La proprietà dei lotti aggiudicati passa all'Aggiudicatario solo previo pagamento integrale del prezzo di aggiudicazione, spese e tasse incluse. Nel frattempo ALDE ha il diritto di trasferire i lotti non ritirati presso i magazzini a spese dell'Aggiudicatario. Si possono eventualmente aggiungere spese di trasporto e manutenzione. In mancanza di pagamento da parte dell'Aggiudicatario, dopo un ulteriore sollecito di pagamento, il lotto verrà rimesso in vendita su richiesta del Venditore, partendo dall'offerta fatta dall'Aggiudicatario inadempiente. Nel caso in cui il Venditore non avesse fatto richiesta entro un mese, dopo l'aggiudicazione, la vendita è ritenuta assolta, senza nessun pregiudizio di risarcimento dei danni dovuti dall'Aggiudicatario manchevole. Per di più, ALDE potrà richiedere all'Aggiudicatario manchevole:
interessi al tasso legale aumentato di cinque punti;
il rimborso dei costi supplementari sostenuti per il suo fallimento;
il pagamento della differenza tra il prezzo di aggiudicazione iniziale e il prezzo d'aggiudicazione sull'offerta massima, se questa è inferiore, così come i costi della rimessa in vendita. ALDE si riserva di escludere dalle vendite future, qualsiasi contraente in difetto, o non capace di soddisfare le condizioni generali di vendita.
e) L'Aggiudicatario dovrà ritirare i lotti acquistati entro 7 giorni dall'aggiudicazione (sabato, domenica e giorni festivi compresi). Decorso tale termine, ALDE avrà diritto a trasferire presso dei magazzini i lotti non ritirati a spese dell'Aggiudicatario, ciò andrà ad aggiungersi al prezzo da pagare, alle spese e alle tasse.
