Conditions of Sale

1. Biksady Gallery act as auctioneers and commercial agents for the vendor, thus organising, handling and conducting auctions on his/her behalf. The lots delivered by vendors are subject to sale by auction in the same succession as in the catalogue, that is the representative of Biksady Gallery conducting the auction shall announce the lot number as well as the catalogue price, to which intending buyers make their bids by raising the paddle. Before the beginning of the sale all bidders must register by providing their name and residence, for being able to collect their paddle bidding number. By being issued with a paddle, buyers implicitly acknoewledge that they accepted to be bound by the conditions of sale.

2. The highest bidder shall obtain the legal title of the lot, except for cases the Hungarian State decides to exercise its right of pre-emption - granted by Act LXIV of 2001 - on works of art marked as PROTECTED in the catalogue.

3. The Gallery act as commercial representatives on behalf of the vendor, who authorises the auctioneers to sign a Sale/Purchase Agreement with the highest bidder and to collect the purchase price. The auctioneer reserves the right to cancel the sale of some items listed in catalogue.

4. The purchaser is bound to pay cash an advance equal to 20% of the hammer price either during or immediately after the sale. As soon as the lot(s) has been paid for in full, legal title will pass to the buyer, who may remove the lot(s) on the spot. The commercial agent grants for the purchaser the full settlement of the purchase within 14 days from the day of the sale. The account also contains the amount of the deposit, in case payment is made in due time. If the buyers fail to pay in full for any of their purchases in due time, the commercial agent considers the bid null and void. In this case, the advance shall not be refund to the buyer.

5. The purchaser shall pay to the commercial agent a premium of 21% on the hammer price.

6. After the lot(s) has been paid for in full, the purchaser shall remove it at his/her risk and expense. If the buyer fails to remove the lot(s), the commercial agent is not responsible for its damage, and starting with the fifteenth day from the day of the sale, it is subject to a warehousing charge of 5% of the purchase price per lot per month. In case the purchaser does not remove the lot - despite being noticed by the Gallery, within six months after the auction the commercial agent is entitled to freely resell the item and subsequent to deducting their expenses, they keep the remaining amount as a deposit for the vendor.

7. Any undertaking aimed at convincing third parties to make unreasonably high bids and thus causing a loss is prohibited.

8. Each item can be viewed during the exhibition and on the sale.

9. The descriptions and illustrations serve solely to identification, and the purchaser shall determine the physical condition of the lots and whether they correspond to the description in the catalogue. Objection and contestation after the sale is not possible, save for the case the lot is a forgery and in the catalogue it is marked as authentic. In this case, the purchaser shall notice the commercial agent in writing that in his view, the lot is a forgery within three months from his first doubt but within 5 years from the sale at the latest. The Gallery bound themselves to reimburse for the buyer the hammer price and the premium paid for the lot, that shall be refund to the Gallery, if an independent arbitrator decides the lot is not authentic.

10. The lots are sold without any warranty, with all faults and imperfections they have at the time of the sale.

11. The lots to sell by bid shall not be purchased under starting price. The commercial agent disclaims responsibility for the bid of the purchaser and for the paid hammer price and is not bound to sell or commercialize later the relevant lot at the same price.

12. In case the purchaser does not want to participate in person at the auction, the Gallery bid instead of him/her - based on the purchase order issued to them by the bidder. Please, let us receive your purchase orders at least 24 hours before the start of a sale, or send these by fax to: 0036(1) 780 93 07. To accept a purchase order the payment of an advance of 20% is required, this amount is refund in case of an unsuccessful bid. In case of a successful bid, this amount represents a deposit, the rest of the conditions are the same as in case of a bid in person. If a third person gives a purchase order with a higher amount or a participant in person makes a higher bid for the same lot, the absent bidder shall be refund the advance without any deduction. Bidding by phone is also possible, if a bank guarantee is available. In the event of two intending buyers submitting identical bids for a lot the first bid received takes precedence. 13. Lots marked "PROTECTED" in the catalogue cannot be exported from Hungary. All owners of "PROTECTED" objects of art are registered by museums and the change of ownership shall be declared.

14. Export of cultural heritage is ruled by Act LXIV of 2001. Lots belonging to cultural heritage may be subject to export with the permit or licence of the National Office of Cultural Heritage. The export of lots with or without full export licence (licensing, packing, customs clearance, transport) is organised by an expert company collaborating with Biksady Gallery.

15. The payment of the purchase price may be made by credit cards. Credit card payment carries a surcharge of 3% credit card fee.

16. Items unsold by the end of the sale may be re-auctioned. The Euro rate indicated in the catalogue is only for information. The basis of the account shall always be the exchange rate at the date of the payment of the purchase price.
