Akiba Antiques Terms & Conditions

Auction is in Dania Beach, Florida. All items are available for examination prior to sale. Bidders are encouraged to examine all items in which they have an interest. We try to accurately describe the items being sold, but all property offered for sale is strictly as is, where is, and with all faults. ALL SALES ARE FINAL AND NO REFUNDS ARE GIVEN. It is the bidder's responsibility to determine the exact condition and authenticity of each item. No statement in this catalogue or by representatives of Akiba Antiques shall be considered as a warranty or assumption of liability. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear or imperfections. Unless noted all items have some amount of acceptable wear, scratches, nicks, etc. for their age. Estimates are of market value and are designed to help buyers gauge what sort of sum might be involved for the purchase of a particular lot. Estimates do not include the Buyer's Premium. Estimates are prepared before the sale and may be altered by announcement before the sale. By bidding, you are entering a contract and you are agreeing that you have either closely examined the items, have chosen not to examine them, or have hired an independent agent to examine the items for you.

Terms: All sales are subject to the terms and conditions of sale. Bidding is available by phone and absentee. A 20% buyer's premium is added to the hammer price of each lot purchased 15% on any bids over $100,000. The auctioneer will also have full discretion to reopen the bidding, cancel the sale or re-offer and resell the property. Should a dispute arise after the auction, our sale record is conclusive.

Absentee Bids: Arrangements for absentee bidding can be made by completing and submitting the Absentee Bid Form by 5:00 pm the day prior to sale day. This form can be obtained by emailing or calling our office. All bids must be secured with a credit card number. All absentee bids will be executed in a fair, competitive and confidential manner. While every effort is made to execute and honor absentee bids, Akiba Antiques is not responsible for failure to execute a bid and is not liable for any losses incurred as a result of failure to execute absentee bids.
Live Internet Bidding: Live internet bidding is available during the auction via Live Auctioneers. Akiba antiques will not be held liable for live internet bids that are not sent, received, or executed by the administrator. If you are bidding live, real-time on-line, please bid quickly because there is a time delay in receiving live bids.

Payment: You will be invoiced after completion of the auction. Payment is due within 5 business days after the auction contacts you. Any unpaid invoices will be turned over to Live Auctioneers and you will be "Tagged" and unable to bid on other auctions until paid in full. Checks, credit cards, and wire transfers are accepted. All items purchased via absentee bid must be paid for within 5 business days of the sale date. If a buyer fails to contact Akiba Antiques within 5 business days following the sale, the credit card used to secure the bid will be charged the amount of the invoice. If paying by certified check, Akiba Antiques reserves the right to hold the item until the check has cleared. In addition, items may be paid for with a properly authorized Visa, American Express and MasterCard. Keep in mind, that the buyer will be responsible for the credit card fee of 2 percent. For credit card payments, please contact us. We DO NOT accept Paypal under any circumstances.

Ownership: Item ownership is conveyed immediately following the fall of the auctioneer's hammer. While we always try to store all items with great care, Akiba Antiques will not assume liability for any loss or damage to an item after the hammer has fallen. Bad checks or non-payment of purchases will be prosecuted by Akiba Antiques to the fullest extent of the law, and the names of offenders will be announced to the public and to other auction firms. Buyer pays actual shipping costs, plus handling charges.

Shipping: The purchaser agrees purchases will be removed within 5 days of payement. As the winning bidder, it is the responsibility of the buyer to arrange and pay for packing and shipping for all items. This means the buyer must contact a company of their choice to arrange shipping details. We can recommend various shipping services upon request depending on the item.
