1. Absolute Estate Sales & Appraisals, LLC. DBA as ABSOLUTE AUCTION GALLERY (ABSOLUTE), will be governed by OUR auction terms & conditions. Any & ALL legal actions brought forward shall be governed and enforced in accordance with the laws of the state of Florida. Whether bidding in person or by agent, absentee bid, telephone or other means, the buyer shall be deemed to have consented to the jurisdiction of the state courts and the federal courts within Broward County State of Florida.
2. Auction Preview: ALL items are available for examination prior to sale by appointment only. ALL merchandise SOLD AS IS, WHERE IS, we try to describe all items accurately, in the event we fail to mention a flaw on our descriptions, please review our photos as they form an IMPORTANT PART of our DESCRIPTIONS. Keep in mind that there will be color screen variations, we WILL not be held liable for those variations. By bidding on our auction, you have either agreed to NOT inspect, to inspect the item personally, or have the item inspected by a third party and form your OWN opinion as to condition, value, originality, and all matters.
3. ALL our statements are merely OUR opinions, these include but are not limited to Condition Report, Authenticity, and Market value. All statements, written, verbal, made in the catalog, advertisement, invoice, bill of sale, shipping statement, posting, announcement, comment by the auctioneer, or otherwise, should NOT be deemed as any warranty or assumption of liability.
4. Please note that many framed items will be UNFRAMED to check for damage or to avoid missing any flaws that might have been covered by the frame. For all other Framed items, the item will be SOLD AS IS (framed), ABSOLUTE will NOT be held Liable for any flaws that arise from the removal of a frame after the sale is complete.
5. No written or implied warranty is made regarding the working condition of watches, clocks, electronic or mechanical devices of any sort or that any such item is in working condition or without defects, restorations, or replacement parts.
6. All measurements and weights are approximate.
7. All Sales are FINAL, Refunds are offered ONLY if an item is found to be forged. REFUND request MUST have a written report of a recognized expert in the field (paid for by the buyer & not affiliated to the buyer) that states beyond a reasonable doubt that the item in question is FORGED, within 15 days of receipt of the item, the item must be returned in the same condition as purchased. NO cost associated with shipping from and to our warehouse will be refunded, ONLY FULL purchase price & buyers premium will be refunded.
8. Phone Bids & Absentee Bids: Arrangements for bidding can be made by completing and submitting either form by 5:00 pm the day prior to sale day. This form can be obtained by email request, at our web page, or at our warehouse. All bids must be secured with a credit card number.
9. ABSOLUTE will make all reasonable efforts to contact the phone bidders, to execute absentee and on-line bids, but accepts no liability for the failure to reach phone bidders, for any errors or omissions, electronic mail receipt, equipment failure, inability to access the internet, software malfunctions, or any losses incurred as a result of failure to execute bids.
10. Reserve Price: in most cases the reserve will not exceed the low estimate and/or starting price. The auctioneer may, in his/her sole discretion, refuse any bid, advance the bidding, or withdraw any lot. In the case of an error or dispute during or after the auction, the auctioneer may in his/her sole discretion determine the successful bidder, continue the bidding, cancel the sale, or re-offer the item in dispute. In the event of a dispute after the sale, ?ABSOLUTE? record is conclusive and binding on all parties. Winning Bid: The winning bid is the highest bid acknowledged by the auctioneer. In the event of a tie bid, the winning bid will be determined by the auctioneer, ?ABSOLUTE? record is conclusive.
11. In the event of a buyer winning several lots and not paying for a particular lot, ABSOLUTE will cancel the sale of the particular lot and all other lots won and paid for by the same buyer, buyer will be liable for the total purchase price of ALL lots, ABSOLUTE will retain ALL partial payments made by the buyer, & resell the ALL lots won by the buyer either privately, or at public auction. Buyer will be banned from all future auctions.
Shipping Terms
1. We use Pak Mail as our third-party shipper for most items, see their contact information below. You will be invoiced separately for shipping charges. You are welcomed to pick your own third-party shipper, pick up is free at our warehouse location. 2. In house Pick up is available by Appointment only, after payment is verified, PLEASE remember to bring PROPER I.D.
3. In the event you want to pay for an item in person, PLEASE NOTE that: We DO NOT ACCEPT personal checks, business checks, or American Express, ALL OTHER MAJOR Credit Cards are accepted with PROPER I.D. & in accordance to our Payment Terms. Cashier checks, money orders, & wire transfers, must clear our bank before merchandise is released. Signature is required at the time of pick up.
4. PICK up by you or by third party is FREE, and inspection of the item is REQUIRED. Please NOTE that we DO NOT pre-package items, be sure to bring or arrange for proper packaging materials, such as bubble wrap, packing blankets, packing peanuts, and boxes. We do not provide you with assistance for the removal of LARGE items.
5. We work hard to ship your items in a timely manner, in most cases items will ship within 5 business days after payment is verified. If you choose OUR third-party provider, they will contact you with shipping charges and provide you with a tracking number for your order.
6. In case of damage during shipping, ABSOLUTE is only liable for the purchase price & buyers premium paid. We WILL not be liable for MARKET VALUE or APPRAISED VALUE of the piece.
7. ITEMS LEFT waiting for a third party or personal pick up at our warehouse 15 days after payment, will accrue a $10 per day storage fee, all items not picked up after 60 days will be sold or returned to our inventory at our discretion. Refunds for the items will be given after we deduct the amount of storage fees accrued.
8. Our Third Party shippers are: a. Pak Mail (954) 522-4550 - After the auction, they will contact you with your shipping invoice. You will pay them directly. b. Furniture & other large items: Plycon Transportation: Jay Juliano (631) 973-3088 -Quotes at: Jay@Plyconvanlines.com Nationwide ABSOLUTE will not be liable for your choice of any of the above 3rd party shippers. Once the item or items are removed from our premises you assume all liability.
Payment
Invoices will be sent immediately after each auction & payment is due within 5 business days after the sale. Cash (in person), cashiers checks, credit cards (NO American Express), Invaluable Stripe, money order, PayPal, & wire transfers are accepted. When payment is done via cashiers check, money order, or wire transfer, ABSOLUTE with hold the item until payment is cleared & verified by our bank. ALL unpaid invoices will be turned over to Invaluable. Any bidder making a bid accepts personal liability to pay the purchase price including buyers premium, applicable taxes (unless a tax-exempt certificate is provided), and shipping.
ALL payments you choose to make DIRECTLY to ABSOLUTE in the amount of $500.00 or below via Credit Card, MUST be accompanied with a copy of the drivers license, credit card, and match the bidders name and address. ALL Payments ABOVE $500.00 made DIRECTLY to Absolute, most be made via cash (in person), when using other DIRECT payment methods including; cashiers check, money orders, & wire transfer, your item will be shipped, released to you, or to a third party shipping company as soon as our bank clears the payment.
International buyers: ALL payments must be made via Wire Transfer. Contact us for Bank Information.
