Property must be paid in full and collected by the buyer, buyer's agent or shipping agent within (14) days of the sale or a 3% weekly storage fee will be assessed.

Condition reports may be requested up to 48 hours prior to the scheduled start of the auction and are generally not included in the item description. Condition reports are representative of the opinion and observations of J. James Auctioneers & Appraisers and does not express or imply a guarantee or warranty of any kind.
It is the responsibility of the buyer to fully examine the property prior to placing a bid and judging the item(s) for his or her own protection.
All property is sold AS IS/WHERE IS and all sales are FINAL. Announcements made the day of the sale take precedence over online descriptions and printed matter. There are no warranties, expressed or implied, with regard to age, condition, quality, functionality, value, rarity or provenance of the property offered for sale by J. James Auctioneers & Appraisers or any representative thereof. All valuations are considered estimates, and in no way constitute a warranty or guarantee of any kind. The Auction house reserves the right to withdraw lots prior to the start of the auction. Grouping, allotment and placement of consigned items is solely up to J. James Auctioneers & Appraisers.

The last highest bidder recognized by the Auctioneer will be deemed the Buyer. After the Auctioneer announces, "SOLD", no other bidding may take place on the item and the Buyer's bid number will be recorded for payment and transfer of ownership. The title will then pass to the highest bidder, and as recognized by the auctioneer, and the property will thereafter be the buyer's sole risk and responsibility.
The Auctioneer, acting as an agent for the Auction House and Seller reserves the right to reject opening bids that are deemed "too low" (far below the reasonable estimated value of the property), and may withdraw lot(s) from the sale at his discretion.

James Auctioneers & Appraisers or any representative thereof may, in their sole discretion, may refuse or revoke bidding privileges or admission to any person who is either not in good credit standing with J. James Auctioneers & Appraisers, or any person who is deemed to be verbally abusive, disruptive of or harmful to the employees or agents of the venue, Auction House, the auction process or property offered for sale. J. James Auctioneers & Appraisers reserves the right, in accordance with all applicable State or Federal laws, to take legal action against or notify law enforcement of, any person(s) who violate these policies or is suspected of conducting illegal activities during the event or on the premises. The established practices and or policies of the venue or premises where the event is held shall be enforced by the appropriate agents or owners of the venue or premises.

ABSENTEE, PHONE BIDS, LIVE INTERNET BIDS
J. James Auctioneers & Appraisers will use reasonable efforts to execute absentee, telephone bids and process live Internet bids on the buyer's behalf. All bids amounts must be placed in U.S. Dollars. There is no additional fee for this service and is extended as a courtesy only to participants who are unable to physically attend the auction. J. James Auctioneers & Appraisers does not accept any liability for failure to execute an absentee, telephone bid or Internet bid, or for errors or omissions in connection with any such bid.
PAYMENT / TRANSPORTATION OF PROPERTY
Auction Attendees are required to remit payment to the Check-Out Clerk before leaving the premises. Upon completion the Clerk will issue the Buyer an invoice, which they will take to an Auction Assistant to obtain or remove items from the premises.

Internet buyers may remit payment in the form of US Dollars via Bank or Cashier's Check, Visa, Mastercard or Discover. A member of our team will be in touch with you within (1-2 business days) following the sale to obtain payment information and finalize purchases.
The Buyer's Premium on property purchased via live or Internet bidding will be in the amount of 20% of the final hammer price which includes a 3 % service fee charged by ArtFact. All In-State purchases are subject to a 6.25% Massachusetts Sales Tax unless the buyer is able to provide the Auction House with a copy of his or her sales tax exempt certificate to be kept on file, or is deemed exempt from payment due to geographical location (purchaser accepts title to and possession of an item outside Massachusetts).
