Conditions of Business
ESTIMATES
The estimates in the catalogue are based on prices earlier obtained for similar items and are only meant as a guide for the buyer. The price at which the lot will sell can exceed or not amount to the cry price. The reserve can never exceed the estimate.
LIABILITY OF FAULTS
All lots are sold as found: it is the buyer´s responsability to examine and assess the condition and nature of lots carefully before the auction takes place. Any details given in the catalogue, such as provenance, authenticity, age, technique and condition are intended merely as guidance to buyers when examining the lots. If at a buyer´s request, Crafoord Auktioner issues a condition report, that information is intended merely as guidance to the buyer and does not relieve the buyer from his or her duty of examination.
Descriptions in the catalogue are subject to change in the light of subsequent circumstances. Any amendments or additions will be notified at the time of the auction. Catalogue illustrations and illustrations in advertisements are for guidance only, and shall not be relied on either to determine the tone or colour of any item or to reveal imperfections.
Watches and work of watches are sold as objects of art. Crafoord Auktioner does not guarantee that they function technically as timepieces. Crafoord Auktioner will not be held liable for damages on frames, wear and tear during the showing or naturally occurring changes in living materials e g cracks in wood, bleaching in paper etc.
BIDDING
Bidding should be made in a clear voice or by unambigious sign. Bids should be raised by sums appropriate to the current bidding level. At the fall of the hammer, the successful bidder is committed to a binding puchasing agreement. In the event of equal bids, the auctioneer will decide which bid shall be valid. The auctioneer may also decide that bidding should be resumed because of uncertainty regarding the last bid.
Buyers may before the auction, on proof of identity, collect a paddle. Crafoord Auktioner reserves the right to decide to whom a paddle will be offered. The paddle number is personal and shall be stated after a successful bid.
WRITTEN BIDS
Bidding commissions on customers behalf are accepted on proof of identity and are free of charge. Crafoord Auktioner reserves the right to decide if a bidding commission will be accepted. All such commissions are treated in confidence. The request shall be done not later than before the start of the auction.
The mandate shall include the highest price the buyer is willing to pay, exclusive of charge and commision. Crafoord Auktioner bids as advantageously as possible on the customer´s behalf. In the event of equal bids, the first received will have priority.
Bidding commissions are given on the bidders own risk and Crafoord Auktioner can not for any reason be held responsible for bids not being executed. All bidders should be able to document their ability to pay and be able to provide proof of identity at any time. Crafoord Auktioner is entitled to refuse a bid if adequate payment on account has not been rendered.
TELEPHONE BIDS
Crafoord Auktioner offers the possiblility to bid by telephone. Crafoord Auktioner reserves the right to require a reference and to decide if the possibility to bid by telephone will be offered. Buyers who wish to bid by telephone should make a request in writing no later than 18.00 the day before the auction. The request shall clearly state which lots to bid for and what telephone number the buyer can be reached at the time of bidding.
Bidding by telephone is free of charge but the bidder accepts to bid at least the amount of the estimated price. Bidding by telephone is at the bidders own risk and Crafoord Auktioner can not for any reason whatsoever be held responsible for telephone bids not being executed.
BUYER`S COMMISSION
To every purchase will be added a commission of 18 % and a fee of SEK 24 per lot. VAT excluded.
DROIT DE SUITE
On objects of art, an additional fee of five (5) percent of the hammer price shall be paid in accordance with the act on copyright in artistic works (SFS 1960:729), unless the work was created by an artist who died more than seventy (70) years ago. Lots on which Droit de Suite can be expected will be marked with a (D) in the catalogue for the quality auction. Works of art selling for less than 2220 SEK are excluded from Droit de Suite.
EXEMPTION from VAT
Buyers residing in another EU member state than Sweden are exempt from paying Swedish VAT as long as they have provided Crafoord Auktioner with documentation of their VAT registration before the auction.
PAYMENT AND COLLECTION OF ITEMS
Payment shall be made no later than five days after the auction. The sum can be paid by bank transfer, credit card or in cash. We do not accept payment with foreign VISAS, foreign bank checks or credit cards such as American Express or Diner´s.
Items shall be collected within ten days after the auction, provided full payment has been received. If payment is not made within the stipulated time, an interest on arrears will be charged at an annual rate of eight percent above the official discount rate. Crafoord Auktioner is entitled to take necessary steps.
A buyer who has not paid or collected the items in stipulated time is obliged to reimburse Crafoord Auktioner for all costs for transportation, deposit and insurance connected thereto.
FINAL PRICE LIST
A definitive list of prices achieved at the auction is published on the web site after the auction.
BUYER´S RIGHT OF CANCELLATION
If any material statement in the catalogue is directly missleading, this may be grounds for rescinding the purchase. Any defects must be complained of as soon as the purchaser has noticed or should have noticed them, and in any event within ten days of the date of the auction. The right of cancellation belongs only to the original buyer and therefore ceases if the item is transferred to a third person. If the cancellation is accepted the buyer is entitled, against returning the item, to receive the amount paid to Crafoord Auktioner at the purchase. The buyer is not entitled to any additional compensation.
LIABILITY
Crafoord Auktioner´s liability towards the buyer is always limited to a discount or, at most, a refund of the hammer price, commissions and VAT. Crafoord Auktioner is consequently exempt from liability for any direct or indirect injury caused the buyer.
EXPORTATION OF OBJECTS
According to law (1988:950) concerning natural and cultural objects, an export license is required for certain objects.
