Returns and refunds will not be considered unless the request for a return and refund is accompanied by a notarized statement from a generally accepted authority on a particular work. All property offered and sold through First State Arts and Antiques Inc. shall be offered and sold on the terms and conditions set forth below. Buyer shall not rely on the auctioneer, employees, the catalog description, provenance information, and documents, or advertisements in any part, and must rely only on his own inspection, research and opinions of all items: First State Arts and Antiques Inc. offer high-resolution photos for bidders to review and make their own conclusions about the piece. No employee is authorized to make any warranties, expressed or implied, on behalf of First State Arts and Antiques Inc. 3. FOR REGISTRATION. The buyer must complete and sign a registration form and provide identification before bidding. We may require a bank or other financial references. A photo ID and Credit Card will be copied for record. The tax document is provided for tax-free. First State Arts and Antiques Inc. have the right at our complete discretion, to refuse admission to the premises or participation in any auction, and to reject any bid. For first time bidders, international bidders or bidders with poor credit and history records, we will ask a $1000 deposit holding from their registered credit card to get approval for bidding with us. Please note it is not a real charge, just hold to guarantee there are enough funds in the account. If a buyer doesn't win, the money will still stay on your account.
4. THERE WILL BE A 22% BUYERS PREMIUM APPLIED TO ALL SALES PLUS AN ADDITIONAL 5% FOR ONLINE BIDS DEPENDING ON INTERNET PLATFORMS. First State Arts and Antiques Inc. reserves the right to charge up to 30% non-refundable deposit fee to customers who make purchases in excess of $3000, or 5 lots.
5. Successful bidders will receive an invoice by email within 24-48 hours. We only accept credit cards for domestic purchases under $500, this is a 4% transaction fee for a customer to make a payment by card. We accept to make full payment by Money Order/ Check/ Wire Transfer. For Wire Transfer, this is a $30 USD bank service fee that needs to add on the top of the invoice amount. Overseas purchases must be paid for by wire transfer. All payments or settlements shall be made in US Dollars. Buyers can only collect the lots after full payments are made. Should payments be made by check or draft, lots will only be released after bank clearance. PAYMENT MUST BE RECEIVED WITHIN 10 DAYS OF THE AUCTION. If a buyer fails to pay within 10 days, First State Arts and Antiques Inc. reserve the right to enforce payment by charging the credit card on file for the total amount on the invoice. All property purchased from First State Arts and Antiques Inc. must be removed within 60 days after the auction date. First State Arts and Antiques Inc. are not responsible for paid items left for over 60 days after the auction date (unless a prior agreement has been made). Items left after 60 days will incur a $5/day storage fee per item. Once storage fees have exceeded the actual purchase price of the item(s) First State Arts and Antiques Inc. can exercise the right to re-auction.
6. ABSENTEE BIDS As a service to those wishing to place bids, we will accept such bids, in advance of the sale, on bidding forms available from us. In the event identical bids are submitted, the earliest will take precedence. Absentee bids shall be executed in competition with other absentee bids, any applicable reserve, bids from the audience, and bids live on-line. If we receive written bids on a lot for identical amounts, and these are the highest bids on the lot at the auction, it will be sold to the person whose written bid was received and accepted first. Execution of written bids is a free service undertaken subject to other commitments at the time of the sale and we do not accept liability for failing to execute a written bid or for errors and omissions about the written bid.
7. We do not provide in-house Packing and Shipping. We will provide our shipper list to our customers after our auction.
8. Some property that is sold at auction can be subject to laws governing export from the United States, such as items that include material from some endangered species. Import restrictions from foreign countries are subject to these same governing laws. Granting of licensing for import or export of goods from local authorities is the sole responsibility of the buyer. Denial or delay of licensing will not constitute cancellation or delay in payment for the total purchase price of these lots.
9. DISPUTE RESOLUTION All disputes and claims arising out of or relating to events and actions covered herein, brought by or against us, shall be resolved by mediation or binding arbitration in accord with the procedures set forth below. This provision does not apply to claims brought by the Buyer directly against the Consignor, including, but not limited to any action brought pursuant to the rescission provisions noted above.
