Terms of Sale

This public auction sale is conducted pursuant to these Terms of Sale by Antique Works LLC, trading as Hampton House Auctions ( hereafter Hampton House), and licensed and bonded auctioneer, G. Amory LeCuyer VAAL 2935. All lots in this auction are sold As is, Where is. By participating in this auction, by any bidding means, including but not limited to, internet, telephone, mail, fax, email, in-person, or by agent or representative the bidder or their agents agree to the terms and conditions listed in the printed catalog or as posted through the on-line bidding company. No alteration to these terms and conditions may be made by any agent, representative, or employee of Antique Works LLC or Hampton House Auctions.
NO BIDDER WILL BE PERMITTED ENTRANCE WITH A FIREARM.
Each bidder, by bidding in the sale, agrees that a BUYER'S PREMIUM will be added to the hammer price or winning bid of each lot as determined by the auctioneer. BUYER'S PREMIUM will be added to the invoice of each successful bidder over and above the actual sum bid or hammer price. The on-line buyer's premium will apply on all successful on-line bids, even if the bidder receives the lots purchased in person. The Buyer's Premium applies regardless of a bidder's affiliation with any group or organization, and is imposed on all bidders. During the auction event, galleries will be closed. In rare circumstances, an individual with a special need may make a request to view an upcoming lot by submitting a request to the reception desk. The request will be evaluated by the auction manager.

Payment for auction sales totaling in excess of $2,000.00 are strictly cash, certified funds, cashier's check, money order or wire transfer and must be paid for promptly in U.S. funds. Purchases will not be shipped until funds have cleared. Hampton House reminds you that all bidders personally guarantee prompt payment in full. Checks are permitted with identification acceptable to Hampton House. Any registered bidder new to Hampton House may be required to present a Bank Letter of Credit in advance of bidding as a guarantee of payment. Bidding will be monitored. All lots delivered in Virginia are subject to applicable State Sales Tax unless said bidder has demonstrated sales tax exempt status in advance. Buyer agrees to pay any sales tax, use tax, and any other applicable taxes that now, or hereafter, are found to be due by virtue of the sale, and to indemnify and hold Hampton House harmless for any sales or other taxes due there under, including reasonable attorney's fees, costs and any interest or penalties assessed. Buyer shall also pay all shipping and handling charges where applicable. Sales tax is calculated on the final total of hammer price plus the buyer's premium.
Purchasers claiming exemption from such taxes must submit resale or exemption certificates, State of Virginia Form ST-10, or other proof of exemption. Out-of-state Purchasers taking delivery in Virginia must provide an OUT-OF-STATE DEALER exemption form ST-14, or pay applicable taxes due. All purchasers represent that they are not seeking to acquire goods for personal, family, or household purposes, but are bidding for resale purposes; and those submitting OUT-OF-STATE DEALER exemption form ST-14 additionally represent that they are professionals, knowledgeable and fully aware of what they are purchasing, a representation upon which Hampton House relies in agreeing to sell to Purchaser. Buyers picking up lots may be required to confirm this agreement in a separate writing. It is the buyer's responsibility to review the items within this auction.

Photographs of the items in the auction are provided for the convenience of the buyer, but do not offer warranties or guarantees as to condition, value, or other elements that contribute to overall decisions to bid, whether in printed catalog, or viewed on the internet at a web site. All photographs represent the actual items being sold. Hampton House is not responsible for deficiencies in photography, including but not limited to glare, focus, or detail. It is always recommended that a potential bidder view items in person and decide for themselves the condition and value of any object. The presentation of items may from time to include hand written notes as to a prior owner's belief of the condition, value or other information regarding the item. These are in no manner offered as warranties or guarantees by Hampton House as pertinent information to determine the value of any item. Hampton House is NOT RESPONSIBLE for your errors in bidding. PLEASE BID ON THE CORRECT LOT. All persons seeking to bid, whether in person, by an agent, representative or employee, or by mail, must register to bid. By submitting a bid, whether in person, by mail, or through an agent, representative or employee, the bidder acknowledges and agrees to adhere to the Terms and Conditions of Sale. The Terms and Conditions of the sale are available on-line via Proxibid or through the purchase of the auction catalog. All registered bidders acknowledge that they have read and accept all Terms and Conditions of the Sale. The auctioneer may decline to recognize any bidder who has not registered and has not been given a paddle number. Any prospective bidder may be required to establish credit references or submit a deposit of 25% of their bids. All new bidders should be prepared to establish credit with the auction house prior to registering to bid. By bidding, purchasing or offering to purchase in this sale, even if as an agent, or on behalf of a corporation or for another individual, each bidder personally guarantees prompt payment and agrees to be personally liable for the consequences of bidding; all bidders also personally guarantee prompt payment in full, including without limitation, BUYER'S PREMIUM, taxes, surcharges, postage, handling charges, storage costs and insurance charges. Hampton House reserves the right to require payment in full before delivering lots to a successful bidder, and reserves the right to require the principals, and directors of any corporate bidder to execute a guarantee of payment (which, in any event they do by having an agent or employee bid in the sale) prior to allowing a bid to be placed or recognized. Hampton House reserves the right to impose a late charge, based solely upon Purchaser's failure to remit full and timely payment, and which late charge is not related to any necessary storage of the material purchased. Said late charge is calculated at a rate of 11/2% per month (18% per annum), based on the purchase price if payment has not been made in accordance with these Terms and Conditions of Sale. Payment is due within 7 days of the conclusion of the sale and/or presentation of invoice. Purchases not collected within thirty (30) days of the date of sale may, at the sole option of Hampton House, be resold for Purchaser's account by Hampton House, with Purchaser liable for any deficit after Hampton House receives a commission for the same in accordance with its agreement, and thereafter deducts all expenses associated with the sale, including reasonable attorney's fees. No bids will be accepted from minors. By bidding in this sale, the bidder represents and certifies that they are of legal age, are authorized to make the bid that they make, and that the purchase is not a consumer sale or consumer credit transaction. Title remains with Hampton House until paid for in full. Should Purchaser take any action under Title 11 of the U.S. Code, or any state insolvency law, Buyer agrees to promptly return to Hampton House, any lots not paid for. The Buyer agrees to keep the lots fully insured until paid for. Risk of loss is on the Buyer. The highest bidder as determined in the sole discretion of the auctioneer shall be the Buyer. If the auctioneer determines that a dispute has arisen between two or more bidders, the lot may be immediately put up and sold again. Bidders with whom the dispute previously arose shall be without further recourse for any damages whatsoever. The auctioneer reserves the right to refuse unreasonably low bids, which in the auctioneer's sole discretion, are felt not to have been made in good faith. The auctioneer reserves the right to open the lot at a reasonable price determined solely by the auctioneer. The auctioneer shall also have sole discretion to set initial and subsequent bidding increments, and to accept, or to decline to accept, challenges to those bidding increments. Bid and bid increases should follow bid increment schedule. All bids not in whole dollar amounts may be rounded downward by the auctioneer. The auctioneer may open bidding on any lot by placing a bid on behalf of the Seller, a mail bidder, Hampton House, or another participant in the sale. The auctioneer may bid further on behalf of the Seller up to the amount of any reserve by placing successive or consecutive bids for a lot, or by placing bids in response to other bidders. The auctioneer may bid for his, or its, own account at any auction and may have access to information concerning the lots, and items contained in them, that are not otherwise available to the public. Auction sales are not approval sales. In the event of non-payment by the Buyer, Hampton House reserves any and all rights that it would be entitled to under the Uniform Commercial Code, All bidders are encouraged to carefully examine all lots prior to the sale. No lots purchased by those who have viewed the lots may be returned. All oral and written statements made by Hampton House, are statements of opinion only and are not warranties or representations of any kind, unless stated as a specific written warranty, and no employee or agent of Hampton House has authority to vary or alter these Terms of Sale. Any alteration shall be effective only if in writing and signed by a member of the firm. The auctioneer reserves the right to postpone the sale by auction for a reasonable period of time as a result of any significant event which, in the sole discretion of the auctioneer, makes it advisable to postpone the event. No bidder or prospective bidder or purchaser or prospective purchaser shall have recourse as a result of any postponement.

In any event, no person may bid without registering, and ALL REGISTERED BIDDERS including mail bidders and agents by registering or bidding agree to all of the above Terms and Conditions of Sale. From time to time, Hampton House allows parties to participate in auctions or sales through the use of Internet or on-line bidding services or companies, telephones, computers, and other electronic, telephonic, or similar or related technologies or devices (the "Services"). All parties that participate in any way in any Hampton House sale or auction including, but not limited to, consignors, sellers, bidders, purchasers, potential purchasers, and their agents or representatives ("Participants") acknowledge and agree as follows: that there are risks in utilizing the Services or any other technology or device; that all Participants assume all risks associated with the use of the Services or any other technology or device; and that Hampton House does not control or maintain all or many of the Services or any other related technology or device utilized in connection with the Services or any auction or sale. By participating in any auction or sale, or by using any of the Services or any related technology or device, all Participants agree that Hampton House is not responsible for any damages whatsoever. We will also accept gold bullion equivalents, but will not take small children. Should the total invoice of a bidder exceed $2000.00, either in a single object or total account, we require check, personal, business, or cashier's - cash - or wire transfer for payment, credit cards will not be accepted. No item(s) will be released for pick up or shipment until full payment is made and cleared.

All taxes are applied in accordance with federal and Commonwealth of Virginia law. Currently within the state the tax rate is 6% on the total purchase - High bid plus buyer's premium - on purchases made within the state of Virginia - Current law does not require the collection of sales tax on items shipped out of state.
