        Est: $16,000 - $24,000

J.E.B. Stuart Autograph Letter Signed " One There " on Robert E. Lee's Actions at Harper's Ferry Raid.  Two pages on one leaf, 8" x 12.5", no place; no date [ circa February 1860]. An ardent and passionate defense of Robert E. Lee's actions in suppressing John Brown's uprising at Harper's Ferry in J.E.B. Stuart's hand. He originally intended to send it to an unspecified Virginia newspaper but, perhaps thinking better of it, forwarded it to Lee's eldest son, George Washington Custis Lee. That letter of transmittal (a photocopy and typed transcription of which accompany this lot) was initially sent from Fort Riley, Kansas on February 11, 1860. In it, Stuart described this letter, "...I enclose herewith a roughly written vindication of your Pa which I wrote for publication but fearing it might not meet the approval of mutual friends send it to do what you please with it. I do not believe Wise capable of such a thing, as the intimation clearly shows." The letter offered here is titled in Latin " Fiat Justitia, ruat caelum" which translates to "Let justice be done should the sky fall." Stuart writes, in part: " I have just read in a Va. Paper a detailed publication of Gov. Wise's annual message to the Gen. Assembly of Va., and I find in his account of his march to Charlestown on the occasion of Brown's invasion, he unintentionally no doubt, leaves the inference that Col. Lee U.S. Army, sent by the President of the United States to quell the supposed insurrection in granting no terms, acted under his (Gov. Wise's) direct orders. He says ‘I telegraphed to Col. Lee to grant no terms,' and then immediately after, he adds ‘Col. Lee granted no terms.' The facts are simply as follows: in justice to the true gentleman and gallant Soldier, whose modesty would forever prevent any self-vindication – Col. Lee arrived at Harper's Ferry, Monday night at 12 o'clock. Made a rapid reconnaissance of the ground, as much as he could in the dark & gathered the most reliable from the many contradictory accounts of the state of insurgents. Within two hours from that time say by 2 A.M. Col. Lee communicated to me his determination to demand a surrender of the whole party after first dawn and in case of refusal which he expected, he would have ready a few picked men who were at a signal to take the place at once with the bayonet he chose to demand a surrender before attacking, because he wanted every chance to save the prisoners unhurt, and to attack with bayonets for the same reason. He may have received Gov. Wise's dispatch, but the alternative of surrender or the bayonet, I am satisfied was his own...  Col. Lee's name has occurred perhaps less in the papers than many others less deserving, owning partly to his well-known unobtrusiveness, but the Country & the State are greatly indebted to him for his coolness & Sound judgement, and resolution tempered with forbearance in the various duties he had to perform such as military judicial, municipal and even diplomatic. Gov. Wise arrived there at 1' clock – five or six hours after the place was taken... and I do not doubt if he had had the direction of the attack he would have conducted it in the most successful style but ‘Erast vires ante Agomemnona.' Please give this a place in your column & oblige..." Signed, " One There." A touching vindication of the future general that illustrates the evident closeness between the Lee and Stuart families. Robert E. Lee was superintendent of West Point during Stuart and Custis's tenure there and Stuart became close with the family during that time. He formed a particularly close friendship with G. W. Custis Lee and his sister Mary, whom Stuart was sweet on during his school days. Despite Stuart's premature death, the legacy of that friendship was still evident over forty years later when Custis Lee wrote a two-p
